    I bought a 40gb PS3 off a fella in Glasgow for 300 quid. It is now 3 weeks and still no sign. He has said he has posted it and that courier has it and he has sent mails to me saying that he is getting in touch with them and will keep me updated but I have received nothing in the past week. He has 100% rating and numerous positive comments which is why I thought he might be alright but now I reckon he has the console and my money.

    Where do I go from here?

    I had a similar situation with a hard drive admittedly only 30 odd quids worth ...turned nasty with negative feedback for him when he wouldnt refund me and retaliatory for me from him ...About 6 weeks later the bloody thing turned up ...postman said he'd found it lying in a corner in the local sorting office...Just by the by...

    No no it was paypal, but he did receive the money. I have the tracking number but not the courier name, how would I get my money back?

    if you have no joy from contacting the seller,open dispute proceedings through ebay and paypal. you will have your money back in a week or two, i have done 3 times in the past.unfortunately there are a lot of BAD sellers on ebay but i for one NEVER let them away with it.:D

    You have done well to keep your cool so far. Here is how I think you should play it out.

    :- keep records of all communications up until this point. They will prove useful in making a case if needs be.
    :- Send one last mail to the seller explaining your situation and viewpoint, and warn him that unless he locates the item and contacts the courier as to its status (whilst copying you on all communications), all within the next five working days you will be opening up an item not received case. This should be warning enough for him.

    In fairness it could be a genuine case of the courier losing the item. It happens all the time. Give the seller the benefit of the doubt for the next five days. After that, he will be dealing with ebay and paypal.

    Also, bare in mind that you have only got 45 days, from the date of payment, to open a Paypal dispute, so don't leave it too long.

    You can open a dispute without looking for your money back, and this is quite a good option as it keeps Paypal in the loop. Go to the Resolution Center in your Paypal account and start a dispute. Say something along the lines of what bobmeaney says there. Also, ask for the name of the courier company, or if he used Royal Mail/Parcelforce.

    Give the seller a few days to respond to the dispute, and if he doesn't, or the response is inadequate, escalate the dispute to a claim. He then has 10 days to respond before you are automatically refunded.

    Ok folks this is the story now,

    I started a discussion with him through paypal, and he says that he will only give me a £150 pound cheque as this was the compensation package he offered me at a cost of £25. Do I have to accept this now. I suppose £150 is better than nothing but I still feel there is something illegal about making me take that. He is starting to lose his cool as he is telling me it was not necessary for me to make this dispute and that its Royal Mails fault and not his.

    Should I make a claim now as I tried the Royal Mail tracking thing and the reference number he gave me is not identified by them.

    What was the level of buyer protection in the ebay listing?

    The buyer protection connected with that item with PayPal is up to €1,000.

    Will I be made keep the £150 compensation I signed up for by PayPal. I feel I will probably end up with nothing!

    You are protected up to €1k. The seller has the responsibility to prove that the item was delivered to you which he cannot do. I would not accept any payment off the seller that is not a full paypal refund. I would proceed with the paypal claim for non delivery. You have waited long enough.

    He has sent me the Royal Mail receipt which states that the status is posted for the item but it says he can make a claim so why should I have to settle for half the money when he can claim it all back?

    I have escalated it to a claim, I will let you know how I get on!:rolleyes:
