Will i get paid for holidays i'm owed when i leave company?

    Question?

    I'm planning to go travelling for a year or so to Asia & Australia at the beginning of November. I am handing in my notice within the next week.

    I have worked up about 15 days holidays and was wondering will i get paid for those days i'm owed when i leave?

    Alternatively, is it possible to take your holidays within your notice period or is that just cheeky?

    Appreciate any help on this, probably an obvious answer for some but as you might be able to tell i gots my fingers crossed for the monies coming my way!

    Yes you will get holiday pay for any days untaken.

    As Kazzer says you should get back any holidays due to you as part of your final payment from the company.

    You best bet is probably to talk to you boss / human resources / wages dept and ask how much give the notice your employer expects. If he is agreeable ask him to accept that number of weeks, say 2 weeks, plus your 3 holidays weeks due and stop work ie officially go "on holiday" after the two weeks and finally finish up and get your P45 3 weeks later. I'm suggesting this because AFAIK if you get paid the extra 3 weeks wages in your last pay packet you will have to pay full tax on your holiday pay without the benefit of 3 weeks tax fee allowance and then claim it back from the tax office. It will take weeks and weeks.

    Depends on your employment contract and company policy I think. It may be custom for some companies to pay out, but I'm not sure it's a legal requirement.

    When you leave employment your employer is legally required to pay any outstanding annual leave that you are due.

    That's completely up to your employer, they can give you the time off, or just pay you the balance as leeroybrown says they are obliged to.

    You say you have "worked up" that amount of annual leave. If that is through working extra hours rather than your actual annual leave entitlement, then make sure you have it documented.

    Some places have a casual attitude to time in lieu, and if there is no official record of you being owed these days, then it may be trickier to claim it.

    Thanks a mill for all the replies and advice, gonna give in my notice at the end of this week and hopefully everything will get ironed out then............Thailand/Austrailia here i come!!!
