I normally stay away from Hong Kong sellers on ebay, due to the fact that i have a drawer filled with items bought from sellers from the lovely country that no longer work...

like my ipod fm transmitter that has the sound clarity of a untuned radio in a bucket of ****e and my sons psp charger that doesn't charge his psp but smells like burning plastic!

    Anyways....

I went mad last month and decided to purchase a media drive enclosure from a Hong Kong seller.

It cost €55 delivered and it arrived last week.

It didnt respond properly at first, but then when it did, the tv picture had interferance on it - bad enough that you couldnt watch it - and yes, it too now smells of burned plastic and heats up quite well when in use!

I emailed the seller and in fairness he was very quick in getting back to me, and gave me some info, but still no joy.

Now, i have requested a replacement same item, but he ain't responding to my emails the past few days and yes, i do realize, its under my own pocket to send the item back to him registered (€27 an post!) but i haven't received an email with a returns address even though i have requested one.

The Q is this, should i just do a paypal claim and cut my losses and just post it back to him and get my refund that way? What process should i use?

I just want my money back at this stage... getting fed up!

(also, i dont think i can do a chargeback as per some other threads here, as i paid using my paypal balance and not my credit card)

Thanks for any info in advance!

P.s. - ive learned my lesson now - never buying crap from far east again!

Paypal claim is your only hope.

Sometimes they just send out replacements without sending back the original.
They don't cost much to make afterall.

I can totally sympathise with you regarding the quality of the products..
Have 2x USB drive enclosures which work intermittently.
A helicopter that doesn't fly.. worked for around 10seconds.
A FM transmitted that has bad quality but listenable (just about)
Some laptop PSU's that have died after a fwe weeks..
why do I keep going back ?

I think sometimes the 'local' products on ebay come from the same source,
via bulk so it's hard to find a good price/quality compromise.

i have put in the paypal claim and am wondering - if he does not respond within the 20 days set aside for communication, and paypal find in favour of me, does that mean i get a full refund and dont have to post the unit back?

Or will paypal ask me to send it back regardless?

Its just that it would be nice not to have to fork out €27 to send it back!

There's a 10 day limit on waiting for a response, if you escalated the dispute to a claim. If the seller doesn't respond in this time, the claim goes in your favor and you'll be automatically refunded. No further action by you will be required.

Paypal normally ask for proof that you have returned the item,
    before issuing a refund.
Although they're not consistent in many things they do.
I raised a dispute, and got a message stating I was not covered.
A few days later out of the blue I got a refund, without having to return the item.
Paypal = bunch of tossers IMO

The last dispute I raised was for a low value item, which didn't work. Paypal asked me to return it, and recommended registered post. That was just about the same value as the item itself, so I tried to reply to the dispute saying I wasn't prepared to post. In doing so, the fairly crappy system they had assumed I had returned it, but without tracking info, and I couldn't enter any comments. Paypal's reply was that I'd have to wait for the seller to confirm receipt, before I got my refund. I was just about to start a charge back, when the refund came through. No reply was made by the seller, Paypal just refunded and I hadn't returned the item. It went in the bin straight afterwards.

Their system makes no sense sometimes.

Give me a break. Why should anyone but you foot the bill simply because you went mad last month. So you had a bad experience, live and learn.
Instead of whining about the return postage you might spend a little more time reading the refund policy of these sellers. If you are to lazy or stupid to do this then give back your credit card ( they are intended for grown ups ).

What is your problem, Blue-sky? He bought something that doesn't work, he has a right to look for a replacement. Why should he just accept it?

    Somebody's having a bad day... :P

Jor el, Harryd, thanks for the info so far,

seller replied this morning... but just pasted in what he had stated about installing the hard drive and connecting the cables and to double check everything...

I just replied that its not possible to check that as it smells of melting plastic when plugged in and that i await his response.

Ye reckon the likelyhood is that ill have to return it so? (awaiting his response still)

Have you really learned your lesson???
Chances are you are using a computer made in the Far East, The shoes and cloths you wear undoubtadly were made in the Far East. Lets not forget to mention televisions, satellite receivers, digital camera's,mobile phones, games consoles and any of the myriad other paraphernalia
    littering your home, all made in the Far East. It would appear you prefer to smear an entire region of the globe for your problem rather than acknowledging the obvious. The real lessons here are;

    1. Contracts are 2 way instruments, read the small print.
    2. you can buy crap anywhere, don't be such a tight wad, pay the going rate ( either here or in the Far East) and you won't have this problem again.

Yes, but all the other "paraphernalia" from the far east in my home works.

Paypal have asked me to send this back to the seller, (at a cost of €27 tracked with anpost when i checked at my PO),

This is pissing me off as the item was only worth €55.

    My questions are these:

I used funds from my paypal a/c, so i presume i cant charge back on credit card?

What should my next step be?

You assume correct, since the credit card wasn't involved.

Other than send it back? Nothing.
