Work Issue

    Been working in my company for nearly 2 & a half years, Bout 3 months ago i was asked to move to another department. I accepted it and was given a raise for the new position.

    Anyhoo things didn't work out,made a few mistakes(nothing major believe me) and now they want me to move back to my old position(fair enough they said i wasn't right for the job) no harm in trying :D.

    Because I'm moving back to my old job which i don't want to:mad:, They said they are taking my increased wage and putting it back to the old salary i was on...CAN THEY DO THAT? Just change my salary back after giving me a raise? any info would be sweet. Cheers

    I'm interesting in hearing from any HR types on this too.
    I'm guessing they can as you are effectively being demoted and that means a lower wage. Tough situation to be in.

    New position, new contract. If you don't sign the new contract they will have to down the route to fire you instead which can be a hassle as well so it gives a bit of wiggle room but yea, nothing odd there.

    What I don't understand is why would think you should be allowed to keep your new higher salary which you got for new responsabilities which you no longer have?

    Hmmm interesting situation... not a nice one but interesting.

    If you find a legal reason that they can not demote you or reduce your salary you do run the risk of them just letting you go from the position you are currently in as you can not fill all the aspects required in it.

    Bit of a catch 22 but in todays climate maybe your better off taking the drop in money and start looking for a better job? Whats better the dole while you look for work or a decent enough salary while you look?

    But I'm not HR and the above might be crap. Best wait for a HR type answer.

    Cool stuff thanks for the input. I figured being demoted, lower wage. But been hear 2 & a half years everytime i ask for a rise no luck., Thought i'd see. But hey nevermind. I'm on the look out for a new job so.;)

    Forgetting about the legal stuff and all that for a second.

    Do you think they're being reasonable? I do. You are returning to a less skilled, lower paid job. I think if you make a fuss you'll come across as a difficult employee.

    i'm not in hr or to familiar with the legal ramblings... did you have to go on a probationary period for the new role or was it a permanent contract? if it probationary i would say hard luck. but if it is a permanent role i would think the only thing they could do is let you go because you are not delivering the set expectations. again with the economic climate the way it is i would just bite the bullett and not cause a fuss though.

    Thinking further ahead, and not only about the money - is there a future for you in the company? The promotion didn't work out, and you have been demoted to your old position. What are the odds of getting a second chance, with or without a fuss about the pay? Sounds like you won't be in a strong position any time you want to go for another role there.

    Suck it up for the time being and get a new job.

    Good advice there Eoin.
    I feel for you OP, I was in a similar situation a long time ago with a previous employer and I basically did as Eoin suggested.
    Turned out the demotion was the best thing that ever happened me, i'm in a far better place these days and theres pretty much zero chance of demotion as i'm good at what I do and I enjoy it too.
    It probably feels cruddy but you probably have no further to go with this company and its best to start looking at somewhere else, better to be looking while having work..so as Eoin says, suck it up for the moment and keep the head up, it may well be a good thing in the long run :)

    Hard luck OP. It's a different job with a different rate - not a raise per se. So when you go back to old job you go back to old scale too.
