Pay 2 months nearly 3 months late

    Hi a friend of mine is working in a chain of shops which employs 50+ people.Payday is once a month but there always saying theres a problem with the bank details (theres not even I checked them) and can't do a DD and they normally send a cheque out 2 weeks after payday.However they did not send any cheques out,shes nearly owed 3 months wages now.Oh she has gotten payment slips though just no cheque.
    Her manager is saying everything is right on his end and its a problem in the payments section of the company.
    Not one other person is having this problem,the manager has raised it with the payments section but that was 2 weeks ago and still nothing,what would be the next step to take,would threating legal action speed them up ( would go through with it if they didn't pay whats owed)If legal action was taken could the costs be reclaimed from them as they are the ones dragging their feet?

    Any replies and help is really appreciated thanks.

    Ring the department of trade and enterprise maybe? And maybe mention legal action too. Completely unreasonable to be waiting on three months wages!

    I would bet money that your friends MANAGER has been paid...otherwise he would actually be bothering to do something about this issue.

    It's not acceptable but hold off on the legal action for another week.

    If other people are getting paid then it's not a case the company is going bankrupt........hopefully.

    Cut out the manager and go straight to payments, get them to confirm your bank details.
    Why won't they pay direct debit?

    Can a visit to head office be arranged? Is it far away?
    They won't be paying their suppliers two months late and they certainly won't be paying payments staff two months late. In fact, ask the monkeys and clerks in payment what they would do if they were in your situation, (don't call them monkeys :D)
    Can you call to head office and demand a cheque there and then?

    The company is far far from bankrupt their overheads are small and most staff on minimum wage and in one branch alone they take in over €10k (With several branches there not counting the pennies).Yup everyones been paid except her and unfortunately going to their head office is out of the question because its in england!
    There reasoning behind a DD not working is she had given the wrong bank sort code to them ( utter rubbish she told them it 3 times and its been confirmed by the bank themselves that it was right and theres no problem on their end)
    I'll suggest that to her though about calling the payments section herself and thanks for your help guys much appreciated.

    Give her your sort code and account number and say "You have 24 hours to do an express transfer into my bank account or I will be speaking to a solicitor".

    TBH I would be looking for some sort of compensation if I had been unpaid for three months. How have you been paying your rent and bills?

    if the payments section is in england, it might be worth getting your banks IBAN for an international transfer

    Fortunately shes still living at home so thats one less worry,the problem is the so called manager doesn't seem capable of doing a whole lot its more like a "Well everything i've done is right all I can do is tell them you weren't paid"
    Should compensation be sought for the time delay?I haven't a clue what the legal standing is for not getting paid in a reasonable agreed time.

    Ring the citizens advice bureau or the department of trade and enterprise. I'm not sure of the law but it can't be legal to withold someone's pay for three months.

    Doesn't really matter that she's still living at home...IMO they should be offering her some sort of compensation.

    In fact, I would say she could almost take them to a tribunal for constructive dismissal...i.e. she is being forced out of her job because she hasn't been paid in three months and needs to get a new job which WILL pay her.

    Is she the ONLY employee in the shop who isn't getting paid? Get her to demand to speak to someone in payroll and refuse to hang up until he/she transfers her pay to her.

    Call the Financial Department, they can cut her a cheque for the amount outstanding. Simple as.

    Ring the head office and ask whoever answers that you wish to talk to someone about you not being paid for three months. Sure someones head would roll.

    But I would turn up for work and use the company phone to bitch and moan at payments in head office all day long until it gets sorted and then I would bitch and moan some more.

    I actually did this. Turned out there was a mix up with everyone's wages and everyone got paid a week late (monthly pay) except me.
    They apologised profusely on Friday and said they would try to get me a few pound to tie me over but I refused as I needed the entire amount to pay college fees. I refused to go into work on Saturday because of this. On Monday when I went into work I was in big trouble. But I argued my case. I finally got paid about 3 weeks after I was supposed to be paid. Turns out some moron made the same mistake twice with my bank details.

    definitely speak to payroll but also get her to speak to the HR department as they should really be her first port of call, and should be the ones to help her sort it

    I had a similar problem before. Although my sort code was valid, and was confirmed several times by my bank, the companies Micropay program wouldn't recognise the sort code, so payment couldn't be processed to my bank account (despite the fact there'd been no problem paying me for 18 months previous!).

    This went on for about 6 weeks, and they wouldn't give me a cheque until they figured out where their money was going. Now here's the brilliant part...

    During all of this, they were still "paying" me. Turns out some genius had decided that since the sort code wasn't showing, they'd use a similar one to try and process my transaction. All was well and good for the initial 18 months or so with my payments working perfectly. And then all of a sudden they were stopped. The conclusion was that the company had been processing the transaction, someone in the bank noticed it was going to the wrong sort code and manually redirected it to my account with the correct sort code. Presumably they moved departments or left altogether and that's when my payments stopped.

    All this was only sorted after my dad called the manager of one of the branches who he's friends with, and the owner of the company (who's a fcuking family member). How's that for a comedy of errors??

    Pretty embarrassing that you had to get your dad to sort it out, tbh.
