    Hi everyone,

    Apologies if this is similar to anything else on here.

    Recently, we were granted permission to build. We signed all of the relevant clauses etc. As soon as we heard the decision it was all hands on deck and organising the ground works etc.....I even have the whole house decorated in my head!! However, a person who had lodged an objection with the Council then sent in an appeal to the permission to An Bord Pleanala.

    Now, I think I understand what this all means...basically we have to wait for an age before it comes back from them which is fair enough but i was just wondering does it not mean anything that the planning was granted from the Council? Also, if ABP refuse planning can I appeal their decision?

    ABP can overrule the council's decision so you'll just have to wait for the outcome.

    Is the Board’s Decision Final?

    Yes. The validity of the Board’s decision can be questioned by applying to the High Court for judicial review, but the Court will not reopen the planning merits of the case. Leave to apply for a judicial review may not be granted unless the High Court is satisfied that there are substantial grounds for contending that the decision is invalid, and the person seeking the judicial review has a substantial interest in the matter.

    Don't lie back and wait !!! :eek:. ABP will send you the appeal i.e. the text of the appeal . Chase them if you don't get it this week . Get help to make your FORMAL COMMENTS to ABP on the appeal . You may find spurious or even un true statements in the appeal which you can re but . Do not be passive here - you only have 1 month from the date of appeal to comment

    We have an agent working on our planning for us, spoke to him today and he's sent back a letter explaining where we stand on the issue. There are some statements which aren't necessarily untrue but are bending the truth a little so hopefully they will grant it and before the date on the website which is December!! I don't think I can wait that long before knowing.....it'll be torture.

    I wouldnt necessarily agree with that statement. Of course you could be right and it may well be February before a decision is made but I have also seen appeals finalised in 3 months.

    ABP set a "target" time of 4 months in which to deal with appeals.

    The Bord are quite busy at the moment, with some large projects up for decision.

    A mixture of decisions of a national interest and staff holidays etc have increased delays.

    A lot of decisions due in end of July has been postponed till end of August.
    So expect at least a months delay... February might be right.
