My Paypal dispute is closed without resolution?

    Please,
    I opened a Paypal dispute with a seller who never mailed my purchased item.

    The seller fogged me off with some usual crap and then i was away on holidays with no internet and during that period the 20 days period of the dispute ended without any resolution as the item nver arrived.

    I am still at the loss of the payment and not sure what i can do now to get my money back?

    I emailed the seller yesterday but no reply.

    Can you not update it to a claim?

    Did you pay by credit card?

    You should have put it in as a claim, and not a dispute. As you've allowed the time to lapse, there's nothing you can do with Paypal now. You might be able to do a chargeback if the payment came from a credit card. This will depend on your bank/provider.

    It was with Paypal, how do you ask for a chargeback? never heard of this before?

    Ring your bank or credit card operator. If you didn't use a card to fund the payment, then you can't do this.

    Also incorrect. According to terms 13.4a
    Dispute auto-closure after 20 Days. We will automatically close Disputes 20 Days after initiation if the buyer has not escalated it to a Claim within that time period. Once we close a Dispute in this way, we will not allow the buyer to re-open the Dispute or file a Claim relating to the transaction. In certain circumstances, we may escalate a Dispute into a Claim (for example, where a number of other buyers have opened Disputes against a seller who has failed to respond to the notices of Dispute).
    They will not allow the buyer to re-open and auto-closed dispute, but may themselves, under certain (unwritten) circumstances.

    Called my bank who issued my Visa and they said to send in details in writing.

    hey IrishHomer,

    I work for ebay and im familiar with the paypal dispute process...
    you say 20 days has elapsed?.. is it possible for you to paste the item number please?

    you have 45 days from the date of purchase to file and close a paypal dispute.

    If you find your not getting a response from the seller, there is an option in the dispute to escalate for refund.

    paypal will look at the matter and if the seller cannot provide a tracking number (to prove they posted the item) then paypal will award in your favour.

    Please please dont do a chargeback through your credit card company ... this should only be used when a seller is being fraudulant

    Log in to your paypal account, go to resolution centre (top right hand side of your page) and click on open cases.. see if you can escalate the claim.


    If this doesnt work then contact PayPal via telephone

    As you have already opened your dispute and let the 20 day time period pass, you won't be able to continue with a dispute through PayPal.

    When did you buy the item on ebay? You have up to 45 days to file a claim with PayPal and up to 60 days to file a claim with ebay. If its still within 60 days of the auction contact ebay support and let them know what happened with your paypal claim - they will be able to help you then.
