Over booked

    I recently booked a holiday for my family to Spain. Its an ideal location for our two young kids. Today we received a phone call from the tour operator we booked with, informing us that the place were we are booked into is over booked. They are offering us alternative accommodation. The new accommodation is not as good in my view as the one we originally booked and is not what I want. Can I stand my ground and demand to stay in the place I origanly booked? or what are my rights?. Also, this information has come to light one week before we travel. And the holiday has been fully paid.

    Regarding compensation, it will usually depend on what operator you have booked with whether they will offer compensation for the change. This is usually around €50 pp within two weeks of travel date, although some may not offer any - check the T & C's of your operator.

    You can't demand your booked accomodation, if it's overbooked it's overbooked unfortunately. However you have rights to a full refund under the 'Package Holidays and Travel Trade Act 1980' are if you have booked and paid for a holiday in full, the travel agent is not allowed change the terms of your booking without the option of a refund.

    You only have two options i'm afraid, take their offered accomodation and hope for a little compensation or ask for a full refund and try find a better last minute deal? Sorry to hear about this, it's terrible when changes are made last minute by the operator when you have your heart set on a holiday!!
