Question in relation to the criminal justice act

    Trying to keep it on topic for the forum...

    But what is the relevance to section 4 part 2.

    "....charge of the station to which he is taken on arrest has at the time of that person's arrival at the station reasonable grounds..."

    Should this not be both a he and a she as opposed to just a he? Surely a female may be taking in under this?

    Is it a typo ? :)

    Females can and are detained under this section probably everyday of the week but tbh I never noticed the "he" or the lack of "she" in it before.

    The lack of she in legislation is common! But alot of legislation makes reference to it in the beginning by saying that he means he or she.

    On a simular note, I was reading the Constitution recently, and was surprised to read artical 12.3.1:

    "The President shall hold office for seven years from the date upon which he enters upon his office, unless before the expiration of that period he dies, or resigns, or is removed from office....

    At first I thought, wouldnt that make Marys McAlise's presidancy invalid? Would that mean that a referendum would be required in order to allow for a female President? I knew that couldnt be right though. It must state somewhere that references to "he" addresses both male and female personal?

    Courts have ruled on this and women are allowed to be elected president.

    First off I have to ask, which criminal justice Act? Not being smart but want too be sure were on the same page here as there are hundreds of them.

    In the 1984 Act Section 4 (1) states that the section refers to ALL people that have been arrested who are of age, blah blah.

    Most laws now state he or she and Im currently waiting on a shemale to fight one. ;)

    b) Gender.

    (i) A word importing the masculine gender shall be read as also importing the feminine gender;

    (ii) In an Act passed on or after 22 December 1993, and in a statutory instrument made after that date, a word importing the feminine gender shall be read as also importing the masculine gender;
