Charged import tax on a camera I didnt accept

    I was getting a 40D from the US, but decided not to go ahead with it as they were refusing to send it unless I paid $300 for an extra warranty

    So i emailed the seller [although its diff people as they're an ebay business] to say the sale was off

    but they just ignored my email and sent it anyway

    So the head guy got back to me and said he requested the package back, but it got here anyway and UPS delivered it, so I refused it, at which point it should have went back

    but they delivered it again the next day, and i refused it again

    So now they want the import tax and a charge for having to deliver it again

    Im gna call UPS on monday but I dno what to do/expect

    err why didnt you just accept it?you didnt pay the $300 so you're getting a good deal?

    Did they take your initial payment? If so you wont get your money back and officially the camera is yours. After that, its pay the customs duty and excise or dont get your camera. But why did they send it to you if you didnt pay the extra 300?

    Edit: If they did just go ahead and send it without receiving the extra 300 from you then all is good, surely. Thay cant chase you for something if they went ahead and sent it. But I understand what you're saying. And with that extra charge, its tricky. Or what you could do, because it was the suppliers mess up, tell them to deal with UPS and demand a full refund for the camera.

    As a side, you did tell UPS to take it back so the second attempted delivery is their mistake.

    I assume you agreed to pay the postage costs for cancelling the item after it had been sent. So...

    I dont think you'll have to pay the import tax as you can send the item back, and the charge for having to deliver it again seems their fault if you were talking to them and told the guy to return it.

    Best of luck ringing them.

    Interesting case.

    I think though, that since you ordered the camera (even though you then cancelled the order), you are still liable for the import duty, even if you are sending the item back.

    Be very careful how you approach this issue. You might be better off taking the camera and paying the duty.

    i think Paul is right there! you imported the camera so your liable for VAT. I dont think you have to pay any duty on a still imaging device tho!
    I remember reading someplace that you could be caught a number of times if you re-imported the item several times.
    Going to be difficult to sort out i'm guessing.

    No, the camera's gone back already

    first one of the sellers refused to send the camera until I paid for the extra warranty, then when I said I was cancelling the transaction, due to off-site dealing, they said nothing, and just sent it, hoping i'd have no choice but to take it

    Then the head Seller told me that he requested a turnaround on the package, but that if it gets delivered, to just refuse it and it goes back to them

    so thats what I did, and they came back the next day, so i had to refuse it twice, at their error

    but its well back by now


    I had no problem with the tax when I planned to take the camera, but it was shipped against my wishes, and either there was never a callback, or UPS jus didnt do it properly, the latter im goin with cos they're a sham

    ok. i dont get the point of this thread then is it just a rant or warning about the seller?Or are you saying allthough you've turned down the item ups or the ebay seller want you to pay income tax??

    UPS sent me a letter sayin they wanted the import tax & a charge for coming out the 2nd time

    then another letter a week later with a charge for not payin the 1st invoice on time

    I have to wait to call them tomorrow

    All i can suggest is emailing the ebay seller and telling him you either need the money of finding the delivery code(im sure this exists and he has it) and they can sort it out with ups at their end!

    If its gone back and you didnt accept it from UPS then as far as I can see, you owe no import tax and duty and certainly, I wouldnt pay their penalty charge for not paying the 1st invoice. I used to work in customs clearance but i've never come across anything like this. UPS may just be trying to recuperate some of the costs that they've incurred due to them delivering twice but the seller should be liable for the first unsuccessful attempted delivery, UPS for the second.

    As far as I know, UPS would have had to pay the customs costs to Customs and Excise on point of entry, it had to be cleared before the attempted delivery BUT think of it this way, if someone sent a package and accidently got the address mixed up and sent it to me, does that mean i'm liable for VAT and duty? I certainly wouldn't think so. You cancelled the sale so your contract with the seller and subsequently your ownership of the camera was cancelled. If you get your payment back from the seller and they received the camera back then i'd tell UPS to deal with them, and that it has nothing to do with you.

    I suspect UPS are trying to get back the costs for VAT and duty that they've already outlayed but if they keep getting on to you explain the camera has gone back and they should take it up with Customs and Excise about getting their customs fees back. (which incidentally, will never happen!!)

    UPS are a nightmare to deal with! I've had nothing but trouble with them. Had a guy turn up 3 times, while I was at home, but each time he never rang the buzzer, just went back to the deopt. When I rang them, they told me that the he had tried 3 times. No note, no phonecall, nothing. They're beyond rubbish!

    Just ignore them.
    No camera, no tax.
    Its not your fault. Its between them and the vendor.
    UPS are always trying to get people to pay for accepting a delivery.
    You pay the guy who sends it. He pays transit out of that. You pay taxes owed.
    UPS have no right to ask you for anything.

    It was the 40D I was ordering this time. Last summer I got the 350D and they delivered it and I missed them twice cos I was workin, then they wouldnt deliver it to my job, so I stayed in all day, and they never came. then they lost the camera for 2 days. then they found it, but searched it, and took everything apart, and they threw the lens back into the box with no caps, and there was no cap on the SLR itself! they wrecked the box, AND to really crap on my sandwich, the guy finally came at about 10 in the mornin, when they said 3/4pm

    and he left the package on the ground in my driveway like 5 feet from the door!

    They're a bloody joke of a company al2gether


    I got my refund a few weeks ago, and I already ordered and received a 40D from somewhere else so I'll be tellin them where to go

    I'm not sure about the tax issues but just to go off on a slightly different tangent.
    I sent some documents to England via UPS earlier this summer (what summer???). I paid the charge via credit card and had to write the card number on a UPS document. Turns out my card was scammed for more than €1000. The guy has been caught and charged but be careful. Just letting people know.

    I also had a camera robbed off me when in the hands of UPS, what's worse is they don't want to know if something like this happens, you always have to deal with the shipper.

    So basically UPS tried to deliver you a camera that wasn't actually intended for you anymore and wasn't your problem or property?

    Have you told them this and then ignored further communications except for complaining about harrasment?
