Job transfer, What a nightmare!!!!!!!!!!!!!

    The company I am employed by shut down one of their facilities and I transferred to one of the others. I took all of my entitlements with me because I wanted to stay with the company. I was giving a trial period of five weeks to make up my mind on weather I would would enjoy working in the the sister plant which I did and forfeited my package. I turned down quite a substantial package from the move. All was going well until my father died suddenly and my mother who is disabled is now Dependant on me as I am an only child in the family. She needs alot of attention. She has home help calling everyday as I am away all week and only get back at the weekends. I explained my situation to my new employer and I taught they would have been more understanding about my problem. They were not. I now have to leave my job and I am now I regret not taking the package.
    Has anyone on this forum ever had this experience and if so is there any legal channels I can go down to retrieve even part of my package?
    Any suggestions would be welcome.

    no-one will be able to give any legal advice on boards but from a lay-mans point of view I think it is an unfortunate position you are in ....but at the same time you made the decision not to take the package - sounds like the company gave you every chance to do so

    don't mean to be so blunt but as the saying goes 'you can't have your cake and eat it'

    we all make choices in life and unfortunately for you it hasn't turned out great....I wish you all the best for the future but at the same time can't really sympathise- on this occasion - I side with the company as they have abided by all the rules

    as for advice I would most definately seek information through http://www.citizensinformation.ie/ in the first instance - they are excellent with employment situations and will assist if at all possible.

    Your only possible avenue would be to talk to a specialist in employment law and go through the exact circumstances of the redundancy situation. But...

    My reading of the situation i that your position was made redundant, you were offered what you thought was suitable replacement employment, you went through a trial period and subsequently accepted instantly forfeiting all your rights to the redundancy package. I don't see you getting anywhere with any attempt to get around this as your employer appears to have conducted themselves correctly and particularly so as they will be able to bring up the fact that you informed them of your change of circumstances should it get legal.

    I'm with snellers on this one. While I sympathise with your situation I think your employers would be fools if the gave you anything.
