Illness benefit

    Hi, I'm wondering if anyone can help me.

    I've been off work for a number of months with an injury and recently returned to my employment.

    I have been claiming illness benefit whilst off and now it seems that I have to repay my employer a sum of money as they paid me for a short period of time.

    Just what is "holiday leave" and is it different than "sick leave" . "holiday leave" is the only one mentioned on the socila welfare form.

    yes, but my question relates to holiday leave as against sick leave

    Never heard of repaying them...id get advice from the welfare on that!

    sick leave with pay is at the companies own discretion, they are not obliged to pay at all.... whereas holiday pay is days owed to a person through working entitlements and public holidays per working year,as for said company taking money back off you through "sick" pay paid ive never heard of, can that be legal?? would you not have to give them permission to take out of your salary etc???:confused:

    Exactly...id reckon there pulling a quick one infact id be 95% sure they are conning you!

    Did your employee continue to pay you while you were out or were you just getting the state benefit? If they were paying you and you were claiming state benefit on top of that you might have to pay it back to the employee... My wife was out of work due to prolonged sickness, the company continued to pay her as company policy but they had to get certs from her so they could claim a portion back from the government.

    They paid me for a short period of time, which I apparently should have repaid after receiving social welfare payments. Did your wife have to repay her employer a sum of money?

    Don't give them a penny. Never heard of repaying employer.

    if your employer paid you, your full weeks wages while you were out sick they should have been getting the welfare payments paid to them to cover the difference i.e your payment is 197.80 per week and your employer gets that while you recieve your normal wage from them.its a question on the form .but this would be in your contract.

    i had to repay my employer before because social welfare sent the cheque to me instead of my employer but i knew the story so just used to drop the cheques into the office when i picked up the wages until SW changed the payment details.

    I was out sick once and due to go on holidays while out sick .Payroll ran through holiday pay and sw paid me also .When i got back to work i had the choice of returning the holiday pay or take unpaid leave at a later time ,could this be the ops situation ?

    Some employers pay you while you're sick. The deal being that they get the SW money, you end up getting normal pay.

    The alternative being, they pay you, SW pays you, and you end up earning more money by being sick.

    Check your contract. You may well owe them.

    which is why i asked you if you had a contract.
