Notice question

    Hey, just wondering if there is anyone working in HR that mite be able to help me with a small dilemma. So im thinking about handing in my notice, I've been working for the company on a permanent contract for just over 2 1/2 years. My question is this.

    Is your annual leave included in your notice period? i.e I have my 2 weeks holidays on the first 2 weeks of September, so if i was to hand in my notice the day before i went on holidays, would this mean that when i got back id only have to work 2 more weeks and id be gone?

    I presume the company just works out any additional days owed to them an subtracts these from your last months salary or might insist that you work a few additional days, I only have 2 additional days holidays remaining after this for the year btw. Any help would be appreciated.

    Yes, but they'll think you're a **** for doing this.

    Normally employers want their staff to work a full months notice (in the office) so the hand over will be as smooth as possible.

    Irish employment legislation doesn't cover the issue of leave and notice periods so it's a matter of agreement between the employer and employee. If you give your month's notice just before departing on holiday then they might try to enforce a the full month from when your return.

    I don't think they can force you to work the 2 weeks additional after the day mentioned in your notice. They can however cancel your 2 weeks holidays (I do think however they have to pay you for your expenses in regard to your holidays, if they agreed to it earlier on).
    You could always try and say that you are leaving to go to a close competitor of your company (if they don't know already which company you are joining) sand hope that they release you straight away and don't make you work your notice period).

    Cheers for the feedback folks, much appreciated!! I think ill hand it in a week before im due to go on my hols and try and negotiate a finishing date with them then. I'm gonna need as good a reference as possible......

    If you're going to need a good referene then work the montha after you get back. Surely a good reference is worth two weeks work, for which you will be paid, to get a good reference if you do not have another job lined up.
