Being temporarily laid off

    Basically I work in the construction industry,today at work I was told I would be laid off temporarily today wk,until the next project starts,which wont be until the end of auguest/start of september,I was told I can claim the job seekers benefit,my question is though,I was due to go on 2wks hols 2nd and 3rd wk of auguest,Im just wondering am I still entitled to holiday pay?

    Doubt it. The "laid off" part usually means the employer is washing their hands. On the plus side, they're saying you have a job after the "trade peoples holiday".

    If they are broke and trying to cut back wherever possible this will be a common occurance for you. Project finishes, you take a holiday on your own buck while they save on holiday pay.

    Any holiday hours you have accrued are yours and will have to be paid to you.

    Generally if you were being laid off, you would get all your holidays paid out with your final paycheck. As you are being let off for a period and then re-hired, they may leave your holiday hours on the system for when you come back.

    Whatever happens, you can cash in that time whenever you like. If you're going to be out of work for a time, I would request that money as part of your last paycheck prior to the break.

    Incidentally, how long have you worked for this company?

    Was told about this in Fas... If there is a break in your employment with a company at anytime in the construction industry, for any amount of time, then you will not be entitled to any redundancy package from your employer if they decide to let you go further down the line, even in twenty years time.
    The best thing to do is probably go looking for something else even if they do want you back after the week.
    A trend has been noted for companies to do this in the last few years to cover asses for future permanent redundancies.

    Yes, you are intitled to holidays.
    You never said how long you are with the company.Also big or small.
    If you are with them up to a year or more you should get the full two weeks.
    If less than a year you are only intitled to annual holidays (worked in).
    To calculate =13.65 hours for every (4 weeks)(28 days) of employment.
    Do not include public holidays.
    In other words, any public holidays you were paid do not come out of your
    annual holidays.

    Question: was this an actual holiday that you booked time off, or the builders holiday, as it's called, where all trades people get the holiday?

    cheers for all the replys,sorry i have\nt written back sooner,was at a certain music festival over the weekend ;)

    anyway to answer your question,I booked these two wks off back in june,there not builders holidays,I have being with the company 2 1/2 yrs,Im on an permanent contract,basically im being let go this friday for 6wks,until the new project starts in september and what i want to know is am i still entitled to get paid for those 2 wks holidays i booked off?I hope i am i could do with the cash.

    Introduction

    The Redundancy Payments Acts, 1967-2007 oblige employers by law to pay redundant employees what is known as " statutory redundancy entitlement". The amount is related to the employee's length of service and normal weekly earnings (gross weekly wage, average regular overtime and payment-in-kind, all added together, up to a maximum wage at of €600 per week regarding Notified Redundancies from 1st of January 2005 on {507.90 per week prior to that date}).

    A redundancy situation arises where an employee's job ceases to exist, and the employee is not replaced for such reasons as rationalisation/reorganisation, not enough work available, the financial state of the firm, company closures etc.
    Exactly who is covered?

    * An employee between the ages of 16 and 66 (Old Age Pension age). Employees who have reached 66 years of age and whose date of termination is on or after the 8th of May 2007 are now eligible for a redundancy payment under the Redundancy Payments Act 1967-2007
    * with 104 weeks (two years) continuous service
    * You must be in employment that is insurable under the Social Welfare Acts. If you are a full-time employee you must be in employment that is fully insurable for all benefits under the Social Welfare Acts; this does not apply if you are a part time employee.

    Have a look here because if you're a full time employee then you are entitled to a redundancy payment along with the statutory holiday leave that you have accrued.

    You can also claim dole for the time you are laid off. Less the 1st 3 days i think.

    With the company 2 1/2 years.
    Yes you are intitled to full 2weeks pay.
    Also when you sign on you will need a letter stating you are laid off temporarily from the company.
    If you are given your p-45 you can claim back tax after 4 weeks.

    well apparently,im only entilted to 12days holidays,5 of which i have already taken,so i have 7 left! wtf and im gonna get payed for them this friday apparently,i have the email the hr person sent my boss if ye wanna read it?


    on another note,my good mother,rang the social welfare office for me today (thanks mom :D) And they told her it wud be 6-8wks before i get anything?wtf like? and also i need my p45 even though im only being let go temporarily :s.

    rang social welfare myself today,and they told me i dont need any p45 :s and also it will take bout 4wks (if im lucky)before I get anything,but that i can claim off the social welfare officer in my area or sumthing,but that i probbly wont get it as im only 22 and its means tested,**** sake.

    I take it this is your first time to claim social welfare.
    If so,2-3 weeks i would have thought would be normal
    However, you will lose the first 3 days and when your claim comes through
    you will get a lump sum.
    Just thought of something here,i dont think your going to like it
    Because you have 7 days pay coming to you, the social see this
    simply as, you are paid for 7 days after you have finished work.
    Therefore you might loose 10 days signing.
    This is all possible .
    Pity you didnt use up all your holidays earlier in the year ;)
    then it would not be an issue.
    You dont seem to agree with holidays,how about some info on calculations.
