Where to darw the line???

    Right, well this may be the wrong forum but whatsover if it gets moved it gets ,moved.

    Anyway, long story short, bought and moved into new house last September. All's well up until just after Xmas when heating starts playing up. Between all the jigs and the reels eventually gets sorted after having no heating for a month. In April come home one day to find water spilling out the front door, one of the rads downstairs has sprung aleak under the ground and has ruined the timber floor in that room and partially in another. N

    Numerous phone calls later, none returned, and one solicitors letter later, eventually get the builder who fobs me off to the plumber, who after another leak under ground in another room eventually admits responsiblity.

    Anyway, at this stage I've give the guy a quote, he's said he's willing to pay up but has promised on at least five occasions over the last month (three times in the last week)to call up with a cheque to pay for the damge to be repaired. Needless to say he hasn't shown up on any occasion.

    Now if anyone has any advice i'd appreciate it cos i'm fed up of it now and want it sorted. Any idea whats the best way to go??

    It sounds like you are in a difficult position.
    Has the plumber accepted responcibility in writing?

    It seems that your Solicitors letter focused minds and got a result. Unfortunately you may have to instruct your Solicitor to proceed.

    I'd consider getting the works done asap and bill the guilty party.
    Court can take time but sometimes its your only option.
    ( Photos of damage will be very important!)

    Took photos of all damge as soon as i realised what was happening, even before cleaning up. I think i've been very reasonable up till now, solicitors letter was sent as a last resort. I'm concerned though about forking out money for repairs and then trying to get reimbursed, I can imagine a long drawn out battle trying to get my money back after paying out a couple of grand of my own money, if i was to get it sorted myeself. The other side of the coin is that i have two floors ruined which i'm looking at for the last two months which aren't even nearly in the condition that they were put down.

    Dont really want to go the legal route but maybe i have no choice.

    I would imagine that the builder would be responsible in the first instance, he probably had plumber as a sub contractor here, he can then counter claim from sub contractor ? :confused:

    Did you try claiming off your insurance. then let them claim off builder in turn who should claim of the plumber.

    Might save you alot of grief.

    I think you will have seen and know your options by now. You try communication first and if that fails then you need to a solicitor.

    You could try posting this query in the legal discussion forum or maybe even the consumer issues forum.

    There is really no more to be discussed on this matter other than the legalities involved and as we don't do legalities here I'm locking this thread.
