Leaving Job - Payment of Holidays

    Hi Everyone,

    Prehaps someone can advise me plase. I will be leaving my job at the end of July, but I have only taken 2 days holidays since January. I should be entitled to about 10days holidays, less the two I have taken.... so thats about 8 days worth of holidays that I haven't taken.

    Am I entitled to payment for the days not taken? If so, is there any handy piece of online literature that I can print and reference, if there is a problem.

    yes your company will pay you any holidays not used on a pro-rata basis. It is very very common occurance - there should be no question of them not paying you (although worth checking with HR to make sure they have the same figures you do- ask them to clarify how they worked it out)

    Citizens advice would be the site to visit - I'm sure they will have the details there - go to the employment section - your rights (and the companies) will be explained

    Hi guys,

    Im finished next week.

    Im due over 2 days holidays.
    the company wont pay as they are saying i didnt work the full year

    Where do i go from here..../

    Why do you feel you are owed 2 days? Have you worked out exactly how much leave time you have accrued between January 1st and next week?

    HR told me last week that i had 2.8 days holidays...?

    Now this week i have given in my notice, i forfit them, I didnt work the full year to be entitled to them.....?

    Annual leave is calculated on a pro-rata basis. They would have told you your remaining holidays on the basis that you'd be working for the remaining of their annual leave year. If you have since handed in your notice, you could be due less, or indeed you might end up owing them money (depending on their annual leave year, and depending on how much leave you've taken already.)

    It's only logical. If your annual entitlement is 20 days between Jan-Dec, and you only start working there on 1st December, you hardly expect to be able to take 20 days off in your first month? Similarly if you leave mid-year, your leave entitlement will be adjusted accordingly.

    Yep i now understand that, think its a bit poor really.

    Now this is where it gets interesting in my opinion.

    The company set up a new policy for 2013-2014 year.

    No holidays are allowed in 'peak' period.

    they have deemed peak period is between mid Nov to the end of Dec...

    Is there not an argument there on that basis so.

    Or can the company make up the rules to suit them selves....

    Holiday leave is taken at a time agreed by employer, so if the employer decides that no one can take holidays during peak trading periods then so be it, to be fair they let you know in advance what their policy is. As stated above, you were probably told that you had days left based on you working there a full year, as you are leaving early then holiday leave accrued would be reduced. It really doesn't matter if there is a period during which you can't take holidays, if you have no holidays to take.

    As for it "being a bit poor really", why?, do you think it's unfair not to be given more holiday leave than you have accrued/earned?
