First purchase on e-Bay

Last month my brother bought an item on e-Bay for the first (and last) time. The very next day he got an email from e-bay to say that the listing had been removed as it breached one of their policies - no further explanation. He contacted the seller as payment had gone through and the seller said that she'd look into it. Of course she didn't.

He contacted the seller again and requested that she either send him the item as he'd already paid for it or refund him. Naturally, she didn't do either and now won't answer any e-mails.

I've just spent the past hour trying to open a dispute on my brother's behalf but I can't as I can't enter the item number as the item was removed. I can't even find a way of contacting someone via the help page on e-Bay. Is their any way around this so I can atually contact a human being direct on e-Bay?

Didn't he get the initial email telling him that he had won the item? Surely the item number is on that.

If he paid through Paypal, then start the dispute there. eBay will not get his money back so it's pointless doing a dispute with them.

genie if he paid by anything other than Credit Card or Paypal then you can forget about it, the money is gone.

If he used Paypal the situation is this:
Paypal give you I think 60 days to start a dispute on the payment you sent. They will more than likely rule in your favour, however even if they do rule in your favour they may not give you your money back if the seller has no funds in their Paypal account. Paypal will not pay you out of their own pocket. Failing any resolution with Paypal you can then contact your credit card company, explain the situation and tell them you want to make a chargeback for fraud through Paypal.

It's actually 45 days (only 6 weeks) but the rest is correct. If the OP's brother has waited longer than this (maybe, since the sale was in May) then they'll do nothing, and a chargeback will be the only hope.

You're right, it is 45 days. I managed to contact Pay Pal Direct (after going round and round in circles on their website) and they've just replied saying that as it's over the 45 days now, they're going to do nothing and that I should try contacting the seller again. I've just spent the last, I don't know how long trying to do that and she's not replying to any e-mails so that's pointless.

I've just been back onto e-Bay and I can't even leave negative feedback on her because the transaction might as well not have taken place. Is there any other way I can do this? I just don't want her to feel that she's got away with it.

Good grief, no wonder I've never bought anything off e-Bay and never will! :)

eBay is fine, as long as you don't expect too much, don't expect amazing bargains (although there are good prices on a lot of things) and know what to do when something goes wrong. Shouldn't have waited so long and never just trust a seller to just refund. A dispute started on the day eBay contacted him would have had his money back in 10 days.

Well as I said, the only way now is to contact your Credit card provider and tell them you were a victim of fraud on ebay through paypal. Tell them you want to make a chargeback. You may get kicked off Paypal but I don't think you should care if you don't plan on using them again with that credit card. You can always use another one under a different name in the future.

They shouldn't be able to do that as it's not against the terms of service to do this. They will contest it, and it's up to the card company to decide whether to charge back or not. Any penalty applied to you by Paypal for doing this should be reported to the card company. Paypal have to play by the card companies rules, they don't get to choose which ones they like.
