Backup copies of a NDS game ??

    Hi,

    I was wondering about the following.

    I know it is legal to make a copy of an owned CD or DVD for your own use.
    Does this follow onto Games - nds, psp etc.

    Not for use by anyone else, or sale but as a backup ?

    Was just wondering, as above it is ok to do so with owned copies of cd's and dvd's,

    I don't think it is legal to make copys of cartridged software. I'm not sure though.

    Well it is a very grey area but in theory I suppose it is legal if it is legal to own back ups of your CDs and DVDs (this of course depends on where you live and under what legal jurisdiction) BUT making backups of games is not trivial like making a copy of a CD or DVD and the investment in the correct hardware for every console you own would be quite expensive.

    It is used, of course, as an excuse for piracy which allow downloads of ROMs etc i.e. "they are provided as just backups of games people already own" but lets be honest how true is that gonna be?

    You could probably HAVE a backup of a game (ds,psp) legally, but in order to USE it, you would have to use illegal means. And there's no point in having a backup if you cant use it!

    Well I don't know the legality of home made roms so I'm staying clear that part of the discussion but all you need to make and use them is a flash card, and aren't they legal to own and use for homebrew?

    The PSP requires actual modification of the consoles firmware, the legality of that varies depending on where you are.

    But I'm no expert on the law.

    Yes, they are. You don't need to own any illegal devices or perform any modifications to run back-ups on a DS.

    As for machines that do need a modchip installed, in the MrModchips case over in the UK a judge recently ruled that modification doesn't infringe any copyright in itself, so it's perfectly legal too. :) (Edit: that's in the UK, of course, but his logic is sound and there don't appear to have been any similar prosecutions over here.)
