District Court Outcomes

    Hey folks,

    Just a quick one. What is the easiest way to find out about case outcomes in a district court?. Can you find that kind of information on the net anywhere?

    DC judgments are not reported. Newspapers are your best bet.

    If you after a particular verdict in a specific case in a specific DC you might try contacting the District Court Clerk.

    If you are looking for a "law report" though it is the newspapers as Rhonda9000 says.

    It really depends of the type of case. Most civil stuff in the DC will not be reported in the local papers. It is generally only the criminal stuff that will make it into the papers. Note that the papers only tend to publish the juiciest cases and may not report on every case on that day.

    hello-just looking for advice-was wrongly convicted in district court for no insurance-was tried after summons was sent to wrong address so never had a chance to defend it-appealed to district court today who adjourned it and told me to speak to the arresting guard-i spoke to the guard who told me all charges would be dropped at next sitting of case in district court on 2nd march-however i was under impression case would have to be referred to circuit court-can anyone confirm this can be overturned in district court

    The District Court has a discretion to set aside judgement in cases where the Defendant is able to show that there was non service of the original proceedings.

    The District Court can hear an application to set-aside a conviction where the person convicted proves that they did not have notification of the hearing date (not necessarily that they were not served) on which they were convicted, and applies within 21 days (from memory) of being notified of the conviction & penalty to have it reviewed & set-aside. This if successful results in a re-hearing in the District Court.

    In District Courts outside Dublin a practical approach is often taken, rather than going through the above fairly convoluted procedure, where if a conviction for not having insurance or what not is mistakenly entered (the person in question being insured) the Court will 'revisit' the matter at the next sitting, where the prosecuting member is satisfied that there was insurance in place.

    Liaise with the prosecuting garda as regards what ever you need to do for the next sittings.

    To find out what happened in a District Court case in which you are a party you can contact the appropriate District Court office and they will probably deal with you fairly practically.
