I lost my dream job over false criminal record

    I recently landed my dream job with a financail service provider. However they withdrew their offer of employmnt when I failed their backround check.

    In 2005 I was convicted of failing to produce a licence, driving with no licence, failing to produce insurance and driving without insurance. I appealed because I had not received the summons and therefore was not in court. I won my appeal and the judge did not even fine me because I had a driving licence and insurance at the time. So I left the court happy that it was all over.

    When I failed the backround check I immediately went to the court. The girl in the appeals office said that according to court records my convictions were reversed and all was in order.

    I then went to the Garda Station and asked the Guard to check for me and to my horror I have had a criminal record for the last two years. I have lost my job and a chane to move back down the country because somebody somewhere did not reverse my conviction on appeal. I am completly devastated as it was a long inverview process and to fall at the last hurdle has crushed me.

    Can anyone please tell me who would be responsible for ammending the Garda database? And do I have grounds to sue?

    Seeing as all was in order on the courts side, it's probably An Gardaí, and you possibly have grounds to sue. Consult a solicitor.

    Yes, I would recommend that you have an aul chat to a solicitor. At the very least, they should know or be able to find out the process which didn't take place.

    Perhaps speak to the company, explain the situation and explain the fact that it will be amended - get a declaration from the court if necessary.
