Arch Techs + building contracts

    Just wondering what forms of building contract are arch techs and other building contract administrators not working in RIAI practices are using, now that the term architect is protected. No one other than an architect can describe themselves as an architect so you can’t describe oneselves as the architect in the Building Contract? It my understanding one can not alter the "Articles of Agreement "of the contract to the substitute the term architect with contractor administrator.

    Wondering has anyone come up against it yet

    Do the Law Society have a Standard Contract?

    Homebond have a standard contract for one off houses.

    I believe RIAI contract is copyright, so its protected, yet the legal terms, wording / phrases, responcibility etc are just words!

    Have self employed RIAI Tech members their own new contracts? (Based on RIAI Contracts)

    Wouldn't it be great if the IATGN could provide a nation contract! Such a Contract could provide / raise funds for IATGN , at €20 per copy.

    A proactive solution?

    I made my own contract about 12 years ago, and after tweeking it with a couple of solicitors I use it all the time. I've had very few complaints and once its signed, witnessed and backed by the solicitors involved, whats the problem. I know this is a rather simplistic approach, but on a similar note how did we work out our detailed specifications, only on a similar ongoing developmental basis.:cool:

    The Law Society and CIF have a standard form of contract which is used for house building (mainly by Homebond members) .

    Your right RKQ the RIAI contracts are copyright. They were prepared by The Liaison Committee for general use in the construction industry. The RIAI publish them on their behalf.

    Any salable standard form of contract would need agreement of the main parties within the construction industry if it was to be accepted as a standard form of contract within the industry.

    Of course one could also use the new form of Government Contracts, which uses the term contract administrator.

    I note in the current issue of CIAT's Architectural Technology that following discussions between the RIAI and CIAT, it was agreed in that the term architect may be struck out in the RIAI Forms of Contract and replaced by contract administrator, until such time as the Forms of Contract have been revised with appropriate wording, now that one needs to be registered to use the term architect. So that solves that problem. Well done to all parties involved.

    Without bringing up the issues of the RIAI and their treatment of non-RIAI architects/technicians, this is one of the areas that I have serious issue. The RIAI contract and a number of its other documents are being passed and understood by the layperson as the only form of contract and documents that can be used for building. IE any other document does not work. For an organisation that is meant to be the the controlling body for architects and architecture in Ireland, to restrict its use to only architects, and its members is madness, and forming a monopoly.

    I have written my own contract based on the RIAI contract, two standard forms of contract and 10 years of experience. I like to believe that it covers more than I need, but would for perception purposes, prefer to have access and use of the RIAI which is quiet good at the end of the day. I also stand to earn more money from it, as you get to charge for every call and every stamp as an extra!!!
