Ebay item not delivered yet

    I purchased an item (using buy it now) from a seller on ebay on the 31st of May. I paid using my credit card via paypal. He has about 1900 transactions and 99.3% feedback.

    It should have arrived about 1 week ago and I mailed him and he sent me a reply asking me to wait till the end of this week. He also said he sent me a dispatch mail saying he had posted it on the 2nd but I received nothing from him (checked spam folder etc.)

    I mailed him today and asked for a tracking number if available to follow up with An Post and he replied saying that he would take it up with the post office personally and that it will take 2-3 weeks to get a reply from them.

    What should I do now? Do I just wait the 3 weeks? Do I open an ebay dispute or a paypal one? What I am afraid of is that I wait 3 weeks and then ebay/paypal say sorry you should have opened it before now.

    Any advice/help is appreciated.

    Slightly further afield, Hong Kong. Normally packages (from other retailers) from Hong Kong take a week to 10 days to arrive for me. It is only worth 25 Euro so I doubt customs have it.

    Check the original listing and see what terms he had for delivery. Usually HK based sellers ask you to allow 21 days for delivery. Also, check did it mention registered post, or standard airmail.

    Once you go beyond the delivery schedule stated in the auction, you can start a Paypal claim, or see if the seller will re-send. Bare in mind that you only have 45 days, from the date of payment, to start a dispute with Paypal, so don't let it go beyond this.

    Thanks for the info jor el, I was concerned that there would be a time limit. The Auction said it would take 7-10 days and it is 21 days today. It was only standard air mail that he was sending it by.

    I have a bit of an odd problem though, paypal say they will automatically close the claim after 20 days, if I open a claim today I will be lying on a beach in Dubai 20 days from now.

    If I file the claim the day before I fly out would it prejudice me if I was unable to respond to any mail from paypal/the seller? Would I be better to open it now and be here to answer all mails or to wait and do it just before I leave?

    When you start a dispute, it will close automatically in 20 days, unless you close it yourself, or escalate to a claim. Once it goes to a claim, each side is given 10 days to reply to the others comment. If the seller doesn't reply in 10 days, you win and get a refund. If the seller replies and your action is required, you have 10 days. If you don't reply, it closes, and you loose.

    Ask the seller for a refund now. If you get no reply, or he refuses, start the dispute and escalate to a claim.

    Well the item arrived this morning so I cancelled the claim immediately. On the package it was dated the 15th (he said he sent it on the 2nd), if he had of just told me the truth that it was slow getting posted I would not have minded and waited the extra time. As it is I left him negative feedback for the lying more so then anything else.
