eBay problems

    I bought an item from a seller on eBay and got a confirmation email, and all the details about shipping my item. They said I would have tracking information by the 14th June and I should check my eBay messages for this. I was checking last night and saw that the purchase was not in my won items list on My eBay.

    I checked the paypal list and got the user name. When I checked the feedback he had already given me, it said no longer a registered user, and the auction had been removed. The email I got has all the users bank details and the website address as well as the users name.

    I sent an email asking if he could confirm everything was ok and got an automated response. I have opened a paypal dispute as this item was a present from my g/f for my birthday. She is very wary of buying online, but I assured her it was ok as I paid by paypal and could get a refund if anything went wrong.

    What should I do? I reported it to eBay over 24hrs ago and have not gotten a response.

    All you can do is wait on the Paypal refund. Have us escalated the dispute to a claim? It'll take up to 10 days to resolve this, but if the user is no longer registered, it should go your way. It'll depend on whether the funds are available to refund too, if the seller has cleared out, you might be out of luck. Try the claim first and see what happens. If you don't get a refund, try the credit card chargeback route.

    It usually takes a couple of weeks for PayPal to responnd. If u open a claim could take a month or more.

    Got this reply today:

    >you had made a dispute in paypal.

    >please cancel the dispute that we can send your item asap.

    I sent one back saying I would, but then realised I wouldn't be able to reopen it or escalate it. So sent another one asking for a refund. Shall I give him time to reply or just escalate it now? (he is in Hong Kong so bit of a time differance)

    Then got this response later:
    Got this reply now:

    >Dear Buyers,

    >Our eBay seller ID is: ************

    >On Jun 10, all our listings were removed by eBay due to our dispute with eBay's listing policy. When you go to our electronicar eBay webpage, there are no listings displayed and eBay has also sent you a notice telling you that the listing of item that you bid has been cancelled.

    (Which they didn't BTW)

    >However, this incident will not stop us from shipping you the item you have paid. Within the following 4 to 7 business days, we will arrange shipment for you and send the tracking information to you via your Paypal email address.

    >As we have difficulties in reviewing your orders from our removed listings, your shipment may be slightly delayed.

    >We like to apologise for this unexpected delay and thank you for your patience in advance.

    But surely they have the details in thier paypal account summary?

    I have asked for a refund ASAP and escalated the claim with paypal.

    A claim takes a 10 days to resolve, not a month. They also don't respond to disputes, they simply allow interaction between buyer and seller, that can later be reviewed by Paypal if there is a claim. Paypal only look at what's going on when it's escalated.

    That's the best thing to do. Asking you to close the dispute before you receive the goods is a common scammer tactic, as it leaves you without any protection later on.

    You should never close a dispute until you've ether received what you ordered, or have a full refund. If the seller doesn't respond to the claim in 10 days, you'll automatically win and be given a refund, if the funds are available.

    Got another mail from him this morning, saying:

    >we can send the item to you.
    >of you still want to have this phone, please cancel dispute from paypal and
    >we will send asap.

    >Thank you~

    Sent reply in caps, saying I want an immediate refund today without fail or I will make a credit card chargeback. (I can't actually do that as I paid with my paypal balance, but he doesn't know that!) It's afternoon in Hong Kong so we will see if he checks his mail before dinner!
