annual leave

    I have a question regarding annual leave,in my company we get 21 paid days per yr plus 4 unpaid,we have to keep 6 days for xmas,I thought this was normal,but my friends tell me there xmas hols are'nt taken out of there annual leave,and anyone ive said it too thinks its weird,was just wondering is this the norm in most companies ?

    Either our friend doesn't really know, or she/he works for a very nice company!

    Xmas hols are taken out of annual leave for all companies I've worked for.
    Unlike you though, I only had one job where I *had* to take a set number of days. Once or twice, I worked all through xmas (expect the public hols) just to save my annual leave.

    That's the first time I've heard that!

    Normally any extra time taken off at Christmas is deducted from annual leave. Every employee would be entitled to the statutory bank holidays (or if they work on those days, suitable remuneration and time off at a later date).

    my g/f works out in UCD and her lab is closed for about a week over christmas yet the time isn't taken out of her holidays, even better if she works one of those days(they keep a skeleton shift on) she gets two days holidays in lieu.

    where or for whom does your friend work?

    anywhere i have ever worked the days the office are closed are not taken out of your holidays, only the days you choose to take off are. so if the office is closed for the week of xmas then that is your employers problem and they cant deduct those days from your holidays just becuase they werent open. but if they are open for the week and you book days off from that week, those days are taken from your holidays.

    Well UCD and hospitals says it all. Public sector 'aint nothing like the money hungry private sector, hence you get free days over Crimbo.

    Utterly and completly wrong, the company has the right to decide when all of your holidays are to be taken taking into account your social life.

    sorry but i have never had to take xmas out of my holidays if the office was closed. your employers cant decide they are closing for xmas but that its coming out of your holidays. if the office is closed but you are available to work that is hardly your fault.

    for example my last job closed for 2 weeks overe xmas, so i got 2 weeks off fully paid. it didnt matter what holidays i had because holidays didnt come into it. the office wasnt open so there was no work. and as i said i still got paid.

    my job before that they were open over the xmas, except for the main days like xmas day, stephens day, etc. i took 2 weeks off over the xmas but i had to take the days out of my holidays.

    I agree with Nody on this - I know many people who have had to take their annual leave when the office closes over Christmas and on Good Friday.

    In some places you may get some extra days allocated to you to make up for this, but in some places you don't. Your experience does not preclude that other people have had different ones.

    Yes they can and no, your experience does not some how change the law.

    From Citizeninformation on taking Annual leave.
    It is for your employer to decide when annual leave may be taken, but this is subject to a number of conditions. Your employer must take into account your family responsibilities, opportunities for rest and recreation that are available to you and to consult with you (or your union) at least one month before the leave is to be taken.
    Notice that the office being closed for Christmas is not listed as part of the legal requirements.

    Our offices are closed over christmas and this is not taken out of our annual leave (21 days). This is a pretty good deal it appears. Then again, I regularly work 50 hours a week (contracted for 33) and there is no overtime arrangement so what they give me in holidays they take away in lost evenings.

    I work for a worldwide 365 days a year company..

    We work Monday to Friday. But the offices are open every day of year. If there is an emergency, and your needed, be it Christmas day or the middle of the night on a Sunday you will be expected to come into the office.

    If you want to take christmas week off, your welcome, but you take it out of your anual holidays. The only thing is, your team must be represented in the office in some shape or form, so *everyone* cant take it off.

    It always really annoyed me that in most Irish companies [and places i worked previously] I had 21 days holiday, minus 4 days as the office was closed over Christmas! I always end up doing feck all for one or two of those days between Christmas and new year, and would rather take the days off in the summer, or around an event with mates like a wedding or going away to a match.

    Ah I get you now. Well, having cover is pretty standard - unless all our of internal customers were also off, we had to have someone there every working day, but I don't mind working over Christmas anyway. Actually, I get bored taking Christmas week off.

    As others have said, yes they can.
    I have never been in this situation thankfully, i've always been able to more or less choose my own annual leave but the employer is absolutely within their rights to decide when you take your annual leave (as long as they take into account family circumstances). They can decide that you must take annual leave over christmas when the office is closed.
