    Two questions...

Is she LEGALLY entitled to her accrued holiday pay in her final paycheck or can they dick her around for as long as they want before giving it to her?

Whats the normal waiting time for a P45 upon leaving a company? I've read on the last day but thats its not in any laws or anything. Any ideas?

Probably a better place to ask....

Almost positive she would be entitled to any holiday pay she has worked up, though I'm open to correction.

A girl left where I work recently, and she got her P45 within a fortnight.

    Edit -
    Damn. Beaten to it.

the norm is 1 week to give your notice. you should have your p45 on the last day of work. at the most it should take only 10 working days for all of this to be sorted. you are entilted to your holiday pay, eg 1 months work usually 1 and a quater days holiday. you should get your week in hand, any outstanding overtime pay, your holiday pay. if it goes past 2 weeks then i think your getting messed about. this happened to me before so i rang the inland revenue and told them that my employer said he would take as long as he wanted and after they contacted him i had all related tax items within 3 days.

I would tend to disagree with the above advice...

Your P45 won't be ready until they caculate your final pay. That may not be done until a few days before payday.

For example, your girlfriend gives her months notice on the 15th of June. She normally gets paid on the 30th. I would expect her to get her final pay on the 30th of July, and her P45 a few days later.

P45's are not as essential as people think. You can simply ring the tax office and get your tax credits. You should never have to pay emergency tax.
