holiday pay in part time job

    hey im just looking for any with any info on this.im 19 a student and currently work part time in a regular shop like mace.Ive been working there since easter of last year.im just wondering if i havnt taken holidays since starting there and i do decide to leave at somwtime will i be entitled to my holiday pay if i leave?also do you loose your holiday pay every year ending or is it carried on from when you start to when you end?thanks alot just a few of us in work wondering because our employer told us we are only entitled to holiday pay if we actually get on a plane and leave the country not if we just take a week off or something.thanks for any info on this!

    As far as i know, any time you take off as "holidays" will mean you recieve holiday pay. However i know when i was working in tesco, if you didn't take your holidays, you simply lost them after the end of the year. they try and make you take em when they think thats going to happen. With another place i worked i was entitled to a weeks holidays and when i left i was given that extra cash.

    Rubbish!

    As a part timer you are entitled to 1/8th of the hours worked as holiday pay, regardless of how you spend it.

    It does not carry over year to year.

    You are entitled to have it payed if you leave as either holidays or money at the companies discretion.

    Your boss is breaking the law.

    Above is the organisation of working time act.

    In short.

    You are entitled to 8 hours holiday pay for every 100 hours worked.

    I cannot believe your employer told you, that you have to leave the country in order to get holidays!! That is crazy.

    It is your employers responsibility to ensure you take your holidays,
    Read up on the booklet, and print out a copy for your boss and give it to him.

    Agreed.

    I was once told I wasn't entitled to a lunch hour unless I actually ate something. I just laughed. Still got the lunch hour.

    Name and shame - to the labour courts if nessecary

    I would say check your contract but I can ensure that any holiday pay you are entitled to does not depend on you leaving the country.

    As far as I know the norm for part time workers is that you are entitled to 8 hours holiday pay for every 100 hours worked. If you leave the job you are entitled to this pay.

    As for carrying it over I am not sure. I know in my current job we are only allowed carry over a certain amount of days into the next year, while in previous jobs it was based purely on hours worked.

    This is all just from experience so I am open to correction but the one thing I would reiterate is read your contract.

    Just another question regarding holiday pay and how it is to be issued, Can the employee receive his entire entitlement of holiday pay when he/she takes leave, however lets say they're taking only 4 of their entitled 20 days, does the employer only have to pay for the four days taken off or can the the employee receive the full 8% of their worked hour to date, despite only taking 4 days off?
    (ie. the other 16 days he/takes off later in the year will be unpaid)

    I ask because im taking 4 days off work to go away, my employer just wants to pay me for the 4 days i take off, but id like all my holiday pay im owed to date. He says ill receive the rest of my holiday pay when you take the remainder of the days off. Im just wondering is it up to the employers discretion how they pay my holiday pay, or can i claim the full whack off them?

    Its not holiday pay, its paid holidays. If you are only taking 4 days off then you will only get paid for those 4 days.

    surly your not entitled to both ??? Take holidays and get paid for the days and also get Holiday pay!

    Yes, of course you're entitled to it. The only people who aren't are those that get their summer part-time job, and then go on holidays 2 weeks later, because they haven't enough hours worked to justify it.

    Just be careful here. Do you have a contract? Some places that pay hourly include your holiday pay in that wage. i.e. the wage is €9 an hour with 1.20 holiday pay making your wage €10.20 an hour. This is your holiday pay then so you won't get any if you leave/go on hols.

    Only some places do this and if your boss is mentioning holiday pay then they probably don't but it's worth checking your contract. (which btw you should legally have!)

    One place where I worked did that. I received my holiday pay on top of my wages each week. Before that we had to claim our holiday pay every year.

    Pretty sure this is illegal, its definitely illegal if they don't explicitly inform you of this when you start. My ex ended up going to the Labour Court when her former employer tried to tell her this when she asked for her holiday pay. Think they told her it was illegal and she won.

    I think you are entitled for 8 hours off for every 100 hours you work.. Something like that..

    I just came back from a holiday over new years week. Im a part timer, the days of my holiday week were; Monday 28th (2-9)BANK HOL, tue 2-8, wed 9-1, thur 9-5, Fri 1st (9-1)NEW YEARS DAY then mon 2-9, so i really only took 4 days. I got paid today and was left short I dont know how my boss worked it out but im sure that i wasnt paid correctly or paid for new years day. Im on 10euro an hour could someone tell me what i should have got so i know that im right about it before i say it to my boss.

    Bank holidays - double time + day in lieu (or triple rate)
    Holdiay pay - 8% of hours worked, no excuses.
    UNLESS you have signed a conteract stating alternatives.

    If you're not getting this, boss is pulling a fast one.

    I was working part-time in a company last year, still there this year, and I was not paid any holiday pay, I didn't know I was entitled to holidays (I know, my bad) but the company never informed me either. Just wondering is it possible to claim my holiday pay from last year or will I just have to forget about it?

    I work occasional contracts for a semi state and every time they employ me (worked 2 days this week) I get my pay and my holiday pay and its calculated at 8% of my earnings.
    Now I may not work again for them for a month or two but I'll get the same pay and holiday pay

    While I was working this week I met a girl who is setting up a company to provide HR documentation and compliance to small companies. She mentioned that if NERA inspect you and find that you (the company) haven't been complying with your legal obligations-proper rosters, proper contracts, pay slips etc it can cost the company a fortune in fines to get it all sorted out.

    So if your employer isn't giving you what you're due-get in touch and make a complaint or ask them to inspect your employer
