Landlord Deposit question

    Hi,

    Moving out off our house at the moment, well moved. We were renting in another house for over a year, paid deposit, cheap and cheerful, no tenants agreement and no lease. House was in poor condition, issues the landlord never fixed, part of the reason why we're moving.

    Landlord is withholding our full deposit to pay bin charges for the last year, our argument with him is that, its a bit rich to withhold our deposit for this, give us our deposit and show us the bill and if we owe we'll look after it. But he is being so ignorant that to be honest we're thinking off just going to the small claims order so we don't have to talk to him anymore. If he paid the charges for last year then its his problem, because there is nothing writing.

    The deposits he is withholding belong to people who moved in during the last year, most recently one of the guys moved out and another fella moved in and the new guy paid the guy moving out for his deposit.

    We're pretty frustrated with him at the moment we've gone and talked to him and tried to work it out sensibly but its like talking to a wall, so I was wondering what should we do here, take it as far as the small claims or let it go..

    Id ask him whether he pays tax on his rental income. Ask him for his PPS number and he might change his tune
