    Hi guys and gals,

Can someone please help me with this one?..................

How do I transfer ownership of a vehicle in the event of death of a parent?

My father did not leave a will and my mother wants me to have his car. I am sure it is probably something simple that I have overlooked. I just dont want to bother my mother with any more paperwork etc if it can be avoided.

    Cheers :)

Just fill in all your details on the back of the VLC (proof of ownership), sign his name, sign your name, send to shannon. ( Prob not the official way but they rarely even take a second look at these things, i would imagine)

    Dodgy one that,

No Will and the owner has died, the state decides what to do in this case.

First of all, my condolences on your bereavement.

As your father died intestate, there's a set down procedure for the distribution of his estate; I'd strongly suggest you have a chat with your solicitor before proceeding any further.

Sorry to hear about your dad... you could go the legal route, but if its a cut and dry case that she wants you to have the car i wouldn't bother...

Just fill out the change of owner ship and send it in.... I done this before when i bought a car from my cousin and she was no longer living in Ireland.... i just filled in her details and mine, send it in as normal, and bob was well and truly my mothers brother....

    Sorry for your loss.
As an earier reply suggested just sign the change of ownership docs and they will never be any the wiser!
But a better solution would be to leave the ownership in your late father name until all the legal stuff is sorted out, you can tax and insure yourself, and this way you avoid speeding fines, parking fines etc, as you are simply waiting for the probate to get sorted.

Insurance won't give you a policy on the car unless the car is in your name.

    False.

Sorry for your loss, but to do it properly, and have the car in your name, your mum will have to extract a grant of probate.
Letters of Administration are issued by the courts giving permission to your Mum as P.R. for your dad, to dispose/adminster your dad's estate..

Wow, that's pretty clever, when the fines arive just send them back a letter informing them that the driver is actually dead and couldn't have been using the car at the time. Genius. I'm going to transfer ownership of my car to my great great grandfather straight away

I would sign his name to the change of ownership form and back date it. Will save hassle in long run as state takes some percentage of every persons wealth that dies intestate. This will include his car and anything that was in his name. You would have to pretend he signed his car over to you before he died.

    +1

I did this when my own father died.

sorry about your loss i was in this exact same situation 2 years ago and know how you feel!

Unfortunately you have been hit with the typical boradsies answers like "the state decides who owns it" and "extract a grant of probate" jesus chrsit like!

Fill out the change of ownership form and sign his name,i did this i didnt keep the car i was selling as my mother wanted rid of it.Never heard a thnig about it.

Although for the benefit of the "do gooders" above i did move to columbia for a year just in case,as i posted on here advice on the situation and letter of probate guy told me ireland had no extradition agreement with columbia!! whoo hoo!

Yes it is. And what your doing is trying to get away with other illegal activities.

    hi
I bought a van at the weekend and signed it as me as the registered owner. How do I transfer it under my fathers name. I have not got the paper work back yet.

    Cheers

Johnny, you will need to go back to the main section and post it as a new thread. Here: http://www.boards.ie/vbulletin/newthread.php?do=newthread&f=47

no they don't, without the presence of a will all property defaults to the spouse.

EDIT: never mind, old thread is old
