Newspaper Name

    I'm in the process of setting up a newspaper and website to be launched this coming September. We are currently deciding on a name to use. What checks do I have to make before I know I have permission to use a name (e.g. copyrights etc.)? Where do I then go to copyright this name?

    I am guessing you would need to check out the patents office for a patented / registered name rather than copyright.

    They are in Kilkenny http://www.patentsoffice.ie/en/homepage.aspx

    also a search with the Companies Reg Office www.cro.ie might throw up something

    Yes the above is absolutely necessary you may also need to search further afield.

    Firstly you should register the title as a business name, then – if necessary as a trade mark.

    I would also suggest that you look and take in the judgement below regarding Herald AM and Metro and the handbags re naming prior to launch of both

    lastly even if there is no other registered trademark against the name (as a huge number of papers are not trademarked) – you cannot ‘pass off’ ie be so similar to another paper that its difficult to distinguish between (ont only in design – but title as well)

    If the name doenst conflict with anyone elses - there should be no problem - and once you publish you de facto have the name.
