Just a quick question, is it legal to shoot rabbits in public places, say dunes on a beach or below the high water mark.?

Assuming of course it is safe to shoot at the location.

If it is indeed illegal what makes it illegal?

The fact that you are discharging a firearm in a public place would make it illegal unless it's an area that's covered by an NPWS " foreshore" permit which allows you access to certain lakeshores and riverbanks in the state for the purpose of hunting with firearms. One of the ranger lads will be able to give more complete info on this I suppose.

To hunt on any land, you must have the permission of the land owner and/or the person in entitled to the sporting rights. The sand dunes are owned by somebaody as are the mountains and every scrap of land in this country. State owned lad requires permission also, usually from the minister or a person appointed by the minister. Foreshore licences apply to the shooting of wildfowl below the high water mark and on state owned lakes and it is illegal to shoot wildfowl with a rifle.
Common sense should be used if hunting in an area that you are likely to meet people. Avoid scaring people, avoid people fullstop, know your ground and have safe backstops for every shot, do not stray outside the area you have permission for.
