Neighbour 13ft Wooden playstructure now overlooking my garden

    Hi,
    I need advice on the following, my next door neighbour has today moved a 2 story wooden playstructure (12ft - 13ft high) over to within one meter (inside his property) of the seperating 6ft chiplat fence between our back gardens.

    Previously the wooden structure location was overlooking the other neighbours on the other side and those neighbours eventually planted trees at their expense to prevent evasion of privacy which they felt they were experiencing from kids playing on the top story of the playstructure and shouting and asking questions towards the neighbours when they came into their back garden.

    My question is what standing do I have with regards to compelling my neighbour to move/dismantle this structure so as it is not overlooking my garden at the very least. Is there planning permission required for such a structure? What process would I have to follow to get something done on this (ie force the removal of the structure from its present position or dismantle alltogether if it goes against planning regulations)?

    Any advice would be appreciated..

    your best bet is to talk to your neighbor - try and sort out without force

    your 2nd best bet in such a case is to try to get the local authority to take enforcement action

    however - in this case the structure may be an exempt development

    breifly

    is the structure under 25m2
    is the remaining garden area over 25m2
    is the ( assuming sloped ) roof under 4m tall

    if yes to above - it is most probably exempt

    In this case - call your solicitor . Private action . We can't advise more in that direction here .

    I know the anguish this can cause but the kids grow up very quickly and you need to balance the short term with the long term.

    The other point is do u want to p..s off young kids now who will become teenagers who could make life a lot worse

    perhaps request that they board up the side of the playhouse, as you fear for the invasion of your privacy... keep any communications civil.

    failing that, ask them why they moved it in the first place??? if the other neighbours have taken remedial action, why has this neighbour moved the play house to create the same issue on his other side??? is he a bit of a assh0le??

    As you cant enter your neighbours property to check the size of the structure you will need to contact your local planning authority and ask them to determine if planning permission is required or not.

    Depending on the outcome of that you may or may not need legal advice. Such advice is not allowed here so Im sorry we cant be of any further help.
