Littering?

    What recourse of action would one have if they were in the process of recycling materials and upon finishing forgot to remove a box that was used to carry the materials from a car to the recycling bank? Is said act was caught on CCTV would there be a legal standpoint of omission?

    Wait, someone left a box behind at the recycling centre? Ooh Lawdy. I suppose its probably littering if its public property, whether intended or not.

    It would be some sort of littering yes.

    There is something in the litter acts about intending to come back for it / leave it there, but I suspect someone leaving a box at a recycling center doesn't intend to come back.

    It is unfortunate then, I would have thought that deliberately committing an offence might be different than commiting an offence by mere omissions :)

    There are plenty of offences that do not have an "intention" element to them - strict liability offences - drink driving for example.
