Xbox Conundrum

My xbox got the three rings of death there yesterday and I am lucky that I am getting a replacement through MS. However, i am thinking of doing this and wondering could it be done:
If I go out and buy a new xbox 360 premium,say in gamestop or smyths, and have my 30 day return guarantee, if i say play it for 29 days and retuurn it on the 29th day, am i fully entitled to do this? By then i should have my own XBOX back you see...

What i would like to know is:

Where is the best place to buy a console, no games ..
Do you get a out of box return policy for 30 days?
