Scammed on eBay

I recently bought a Nokia N95 on eBay and it looks like the offer was fake as I got an email from eBay saying it was withdrawn but "For privacy reasons we can't tell you exactly why we ended the seller's listings".
I'm sure this kind of thing happens all the time on eBay, I presume I am not going to receive the phone, (I didn't get an email telling me it had been shipped) but what are my chances of getting a refund?
I emailed the seller in question just now, I bet he won't reply.

Open a dispute case using paypal and ebay and I reckon you have a pretty good chance.

Ebay won't be out of pocket, if the seller has closed their account you're unlikely to get anything.
Ebays' buyer protection isn't worth ****

Paypal. Money's been debited, €74. I have the seller id and seller email from my paypal account. Surely they can't actually get away with this s***?

Surely you didnt think you were getting an N95 for €74?

I cant believe you didnt smell a rat there.

An N95 for 75 euro, yeah right. This didn't say Garda Auction on it by any chance did it? These guys have been doing some right scams lately with 50" TVs for 70 euro an so on. What you're actually buying is information on Police auctions, not the item listed. Sneaky.

Paypal buyer protection isn't worth a sh1te - if the seller won't refund you they won't do a thing about it other than close their account. I've been an eBayer since day one but it's too much hard work these days scamming has gotten completely out of control and they're doing feck all to stop it.

i know this might sound a bit silly, but is the email you received definitly genuine? like have you checked to it to make sure that it is actually from ebay and that it isnt part of the scam? its most likely not fake but just check it to be sure. nothing would surprise me anymore with the crap these guys are trying.

Yeah, that's them. Bit stupid to believe I could get an N95 for that price I admit. It was late at night when I saw it! It's unlikely I'll get my money back, I'll try anyway, surely there must be others that have been done by these guys?
I'll put it down to experience and be more careful in future.

Got a link to the auction?

If its the Garda Auction type listings then you won't get your money back, PayPal buyer protection only covers tangible items and these auctions sell emailed information.

Next time just take a few minutes to read the auction over properly and this wont happen.

Well a mobile phone is a tangible item, I didn't win it on a bid, I selected the "Buy Now" option.

True, but you didn't buy a mobile phone here.

The whole point of these auctions is to convince people they are buying phones, laptops, tv's etc at cheap prices when in actual fact all that the person is selling is an email with information in it.

So all you have paid for here is an email which is intangible. If you havn't, report the seller to eBay and then file a dispute with PayPal for Non Receipt. You will not win the PayPal dispute but its better to have it filed anyway.

There was no scam and there was no phone. All there was was you not reading the whole listing. If you read it carefully it says that you are not buying a phone but information about Garda auctions. You got exactly what it said in the ad and what you paid for, you just didnt read what it was properly.

I'd like to read the listing properly again to see exactly what it did say. But of course I can't as the item has been pulled. I don't think I'll bother putting in a dispute claim, it will almost certainly be a waste of time.
I haven't bought anything on eBay for a while before this. Are these kind of sales a new development?

I can not believe you will not dispute this. Did you fund your purchase with your credit card through paypal? I would be on to the credit card company to dispute the charge

Well there's not much I can do is there? It's been charged to my card, it's on the statement, even though it won't be taken from my account until the end of the month.

    What can you do?

Raise a dispute in paypal or contact your credit card company to dispute the charge or do nothing. The last option appears to be the less hassle one though

They can dispute it, but from previous experience I think they will just say "once it appears on the statement, finito".

I dont see a reason to validly dispute it in fairness. The seller provided what they said they would in the ad. Just because what it was wasnt worth €74 doesnt change that. These things only happen because buyers get starry eyed at the price and dont read the full listing.

That is the suspicion although the buyer cannot verify that as ebay have deleted the listing therefore I would raise a dispute through paypal and let them decide.

Theres been a few posted before and they usually have it buried inside somewhere that its not actually the phone but the info on the auctions
