Issue with item I paid for via Paypal - what are all my options?

    Ok, i'm currently involved in a dispute in paypal. I bought an item off a user on adverts.ie who has since been banned.

    He sold me 2 hard drives. They came very badly packaged, one of them had an instant fault so I contacted the seller via his mobile number, he told me to post it back to him and he'd replace it, he also told me via PM that since the barcodes on the drives where missing (I believe these where show drives) that he offered a 6 month warranty to himself. I sent the drive back to him and he sent me a working replacement, which I have found no fault with it.

    But then the second drive that came in the first lot developed a technical fault (since the packaging wasn't good i'm assuming they must of got banged around a bit in transit) I tried contacting the seller again. As he was now banned from boards.ie I could not PM him, he also was not responding to phone calls to his mobile.

    So I opened up a dispute in Paypal, to which he responded to. I told him I didn't want to push through a claim and instead wanted to just get a replacement to which he now agreed. I sent back the faulty drive in packaging suitable for posting a hard drive that he could re use to send a working drive back to me, I also sent it via registered mail as recommended by paypal.

    Its been 10 days since I posted the drive and I haven't heard anything via Paypal or my mobile number.

    I'm thinking my last option will be if I don't get a response by Tuesday to push this to a claim.

    What are all my options here? I have his full name, address, mobile number and bank details. How likely are paypal to resolve this issue? What if he's closed his paypal account? Can he close it if he has a claim open? Should I report him to the gardai in his area?

    All or any advice appreciated.

    Once a dispute is started, I believe Paypal will freeze the amount in question in the sellers account, if it's still there. Since you've heard nothing for 10 days, and I assume you've checked the tracking number yourself to make sure it's been delivered, then escalate to a claim to see if that gets him moving.

    That's really your only option, other than waiting longer.

    I'm not sure if reporting to Gardai is worth doing, or even if there's anything to report. It was a private sale between two individuals, civil as opposed to criminal matter. Since you have all his details, and if you don't get a result from Paypal, you would need to get a solicitor involved and see if you can get your money back that way.
