saddled with debt

    not sure if this topic is appropriate for this forum but here goes

    i bought a car this week for cash , i knew that the seller still had debt attached to the car so i wrote up a document stating that the seller takes full responsibility for any outstanding debt or finance on the vechile
    i then got a friend who was with me as a witness to sign , i myself signed and the seller signed the document , we then both took a copy

    my question is , were the seller to renague on his pledge to take responsibility for the debt on the vechile , would this signed homemade document be worth the paper its printed on

    if indeed it would not ( dont need any lectures on the stupidity of it , thank you) could i get my solicitor to draw up an official document of agreement , the seller seems willing to sign such a document but im not sure they would be willing to have a solicitor come over to there house and witness all the parties involved sign off
    would it instead be enough for me to bring such a document drawn up by a solicitor to the sellers house and have the seller sign it with just myself and a mate perhaps as witness

    you seem to have covered the basics for a legitimate contract. Just because it wasn't overly formal doesn't mean it won't hold water legally.

    I await correction.

    Dont waste any more time or money drawing up documents. If the car is financed , you say there is debt attached to it, it is owned by the finance house. The guy your dealing with cannot contract to sell it. He does not own it.
