Handed in notice - bad reaction!!!

    Hi every1,
    After a year and a half of total unhappiness I finalloy go tthe courage to go and get another job, a better job. So last week I handed in my notice(4wks) on late Fri evening.

    On returning on Monday a whole new attitude has been taken towards me - they are being childish towards me and the MD has nearly taken it like I done it on spite to him or something!! To be quite honest Im sitting here feelin as akward as hell, really dont want to be here! But however they are pulling stunts like stopping the payments of my expenses and taking a bonus I recieved from me so technically Im working for free so at the end of my month I will hav no wages and because the way they are acting I am quite tempted to ring in sick for the next few weeks cos I really cant stand being here any more. I cant believe how they have reacted.

    So my question is should I go on the sick for teh next three weeks or not? Cos even though they are treatin me like sh!t I still feel bad!
    So please help me decide !!

    Continue to go to work with you head held high. Keep notes of all your expenses etc and hold on to all your employment contracts etc.

    If at the end of the month you have outstanding wages / expenses owing to you and they won't pay up contact these guys: (I am not sure of the legalities regarding bonuses and or expenses, but you shouuld be entitled to your full wages at the very least)

    **EDIT** From a quick scan of the relevant act my interpretation is that wages and bonuses are covered by the act but not expenses. Perhaps someone with more expert knowledge could confirm/refute this.

    If this is the case I would not dip into my own pocket for any expenses related to work if you are not going to be reimbursed. If this means you cannot do your job properly then that is their fault not yours.

    in exact same boat myself, handed in notice last wed, gave them two weeks as not there a year yet and nothing in contract and being total muppets, thought same myself of ringing in sick but not going to give them satisfaction...at the end of the day, your out of there, you have a new job and in a few months you'll look back and it all will be a distant memory..

    worst year of my life workwise, chalk it down to experience and move on

    Get this one. I only signed a month contract with my current job, big company here in Oz. (Been working with them month to month for a while) I told them I was leaving at the end of the contract. They go ****ing mental, apparently I am important to the completion of this project we are working on.
    So why in the ****ing hell did they not just sign me up for the amount of time they needed me for so I could work around those dates and not my, you know, contract!?!?!

    F them. You have done nothing wrong. Go about your work as normal and just see out your time. Keep track of all your owed and they should pay up at the time you leave. If they don't there's always Joe Duffy, you can name & shame them....

    What is written in your contract?

    I would imagine that you are entitled to wages and expenses. Bonuses can be tricky but if you've been already awarded the bonus, then there is a case for keeping it.

    Contact the National Employment Rights Agency. They should be able to advise you.

    afaik, bonuses are paid at the discretion of the company unless otherwise stated, so if the bonus was due to be paid after you leave the company they don't necessarily have to pay you these.

    Expenses, however, should be immediately reimbursed to you as long as they have been approved by your manager and are clearly work related.

    They can't dock your next pay to reclaim any bonus / expense payments already given to you, thats illegal.

    After all that I am sittin here seriously comtemplating on just walking out, i was going to do it at lunch time but after one too many smart comments I think Im juts gona get my crap together and go - prob tell them Im going to get a breakfast roll or something adn post in an aul sick cert to them! Couldnt be ars*d anymore had enough of this crap!

    IM SUCH A DRAMA QUEEN!!!

    Bonuses are usually always paid in arrears so if you have received it there should be no reason to reclaim it, Sounds like they are being childish I'm taking my fig rolls back because you did not give me a bit of your sandwich :p

    Take the higher ground, walk around as if nothing has happened but keep a note of everything. emails conversations etc..

    You are the one with the new Job and the best of luck with that!! They are still stuck there :D:D

    Is it that easy to get a sick note if your not actaully sick. If you dont need references from them in the future and there is no way leaving the job will affect you starting in the new job also you dont need the money then I cant see any reason you should stay. I wouldnt do it in a lunch break though.

    I was in a similar situation but i was given option of working the notice or nor...would you have that option by any chance as it would certainly help you if you did...

    Watch your account carefully ;) I was promised 4weeks pay plus holidays due from lastyear but on the firstweek no monies went through...they then put through 2weeks and 2+weeks and i ended up being taxed to the hill. It took a phonecall to the GM on saturday morning and a call to personnel on the monday to sort out the payments...i was told it was a computer error :rolleyes: but watch your money carefully, thatcomputer error could resurface...make a note of how much you are certain to receive ie set weekly wages.

    I now have all monies owed to me...a great reference...and a new job which im thrilled with. Just keep the faith and stay on top of the situation...dont let it get the better of you ;)

    I was in a similar situation myself once when I handed in my notice my boss went mental the first thing she said after I said I would be leaving in 2 weeks was "thanks for wasting my time".

    Then all the pettiness started e.g. specifically asking everyone else in the office did they want a cup of tea but ignoring me if I offered to make tea. Snide comments about how there was a mistake with something and it must have been my fault even though I had never worked on that area. Going into the kitchenette (about 4 feet from my desk) to bitch about me.

    After about 3 days I said to my manager that if she could not act professionally about my leaving then I would finish up at the end of the day. She started screaming at me saying that she was sick of me that I was really lazy and none of my work was done to scratch. I have never been lazy in my life and she reviewed all my work and said it was perfect.

    So I got my coat and left. Life is too short to be staying somewhere you don't want to be.

    Tell them that you will be finishing at the end of the week make up some excuse about how your new job needs you to start sooner and go and enjoy some time off!

    no you dont legally have to work your notice...you could come to a mutual agreement and not work but get your weeks' wages. Its at the discretion of each employer AFAIK(well it was with me anyway)...The GM asked me if i wanted to work the month or not and i said it would prob be bst if i didnt...Was told thats grand, you'll still get your monies though...win win ;)

    yeah i was told by people that i was lucky alrite with the people i was working with giving the option of not working it...If the OP has an employer that is giving her grief during this period then maybe they should suggest that it would be better for all involved and maybe they might do the same with her...Depends on how nice your employers are i guess :rolleyes:

    You need to outline which industry your in to best say whats the story

    Basically most sales oriented outfits have a well oiled machine which operates as you have experienced and its nothing personnel it deadly serious how to recover the most cash possible nearly always at your expense and sometimes as they are busy tricking the rest of the staff to work for buttons the last thing they want around is staff who found a better solution so they move into full get the SOB out of there ASAP

    In the insurance world they can often pay the commissions ahead and then when you leave they stop paying it and sometimes try to recoup expenses under obscure things like training cost you must reimburse etc

    New laws have helped reduce these trends but some still exist and you have to go to court to get your money back

    Often The worst outfits are ladies perfume chains which are nearly all commission and when they sufficiently piss the worker off they up stick leave and then they lose their commission usually to the back pocket of the manager but if they stay they often end up working for free and not getting expenses paid for

    Its often a waste of time going to court if this is some small shell company LTD with no assets working under the umbrella of a big sale s company like Insurance Perfumes etc and when eneogh court orders arrive to pay up what they owe they fold up and the assets are zip nada nothing and set up under a different name and the worker gets Squat:eek:

    I would find the Union that handles that sector of the Industry sign up as a Union member and they will advise you best
    Often they now there is nothing they can do but then at least you get real advise and if they can recoup moneys for you from harassment whatever then you might make a few quid back

    Chances are the Union will know all about them and their nasty methods and how to bat back some of the problems

    Whenever possible I try to join a union as often even though they cant do so much they do try have the experts and your far more likely to win against the problem when your in and often bosses wont try this crap if they know your in a Union but a chance to not have to pay a young one with no union behind them is often to tempting a target for greedy bosses that often got there being SOB and selling their grandma for 10 cents

    If you figure out with good legal advice from reliable sourses like your own soliistor or union ( unlikely to get best advice from government agencies as they got to protect them selfs from getting sued )they are real cowboys and they are really tricking all the workers then if you decide that your going to lose your money try to piss off all the other workers with real facts so they all walk out and make the SOB pay for this crappy solution they found

    Lucky when I was working in Germany in the early 90s the laws are so good that often when you would say you are giving the resign notice in they just would pay you the months notice and give you the ten minutes to leave as they don't want any problems and that a win win a months attendance money for nothing but unfortunately half the monthly money is usually bonus which they don't give so you really just get two weeks money but its better than a kick in the teeth
