VWP; Exceeded 90 Days in the Past

    In 2002 I overstayed my Travel visa by one day (91 days),

    May have to travel to Mexico in August this year via the States. I'm going to contact the Visa Information Service but just wondering does this account for immediate expulsion from the VWP?

    No it should not exclude you.

    When you contact the Visa Information Service tell them your story and make sure you can supply evidence that you were back in Ireland at the time to say you were back. (bank details, pay slips, tax forms etc, school attendance, flight deatils etc). They may suggest you get a visa which will allow you tarvel to or transit through the US with any hassle for the duration of the visa or they may suggest you present the evidence emntioned above when you are entering on the VWP on you way to Mexico.

    sorry to give this bad news to you mate but if you overstay on the vwp you are excluded from it in the future.

    have a read down the bottom left of this page from the dhs.

    i think you should get in touch with the embassy to make sure but i dont think you can use the vwp

    when you departed the US after 91 days was the green slip on your passport taken by the airline check in staff ?

    If it was then the DHS may have a record that you overstayed one day. (some say they delete records after 2 years)

    If it was not taken then the entry for you departure date on the system is blank, therefore it can neither be proved or disproved that you overstayed, having lots of evidence that you were back in Ireland demonstrates that you did not blantally overstay your welcome, which is usually good enough for US Immigration
