Just wondering if an employee, who does lots of overtime, is entitled to any payment for that loss of earnings while on jury duty or are they just covered for their basic hours?

what happens if you get called and you dont reply/turn up?

  • Registered Users, Registered Users 2 Posts: 341 ✭✭Croc

Its and offence not to turn up, you could be summoned to court and asked to explain why you failed to turn up. Or should i say (You will be summoned to court)

You must turn up or reply with either a valid excuse for not turning up ( there arnt many ! ) or its an offense and a warrant will be issued for your arrest !

Ive been on Jury Duty 3 times , and if your name is called and your not there , the Judge immediately calls for a warrant.

    Thats not quite correct.

They note those that fail to answer, the list of same is forwarded to Gardai who issue summonses for those failing to attend. They have to attend court as if they were summoned for an ordinary Criminal matter. Failure to answer that summons will probably result in a warrant being issued.

Just want to confirm what Im reading here:

    http://www.citizensinformation.ie/categories/justice/Courtroom/jury_service

I get paid for jury duty as if I was in work. So this means my day of jury duty is not deducted from my holidays?

Your employer may not take the time off out of your holiday allowance, i.e. any time off is in addition to any holiday entitlements you may have.

Sure what would happen if you got caught for a long trial - i.e. more than the usual 20 days you would have for holidays!

I was just going to ask that, I've a friend sitting on a murder trial and was wondering what happens if it goes on for weeks.

He's entitled to be paid for all normal earnings he would have received during that time. The employer is absolutely not permitted to deduct the time from your holidays, even if you had previously arranged to go on holidays at that time.

the judge says at the begining of the trial roughly how long it will take. you are told if you have any commitments that would make you miss any days of the trial then you must say it then. so if you are flying out on a holiday or you have surgery during that time and you know you cant be there for all of it the judge will dismiss you. if you have a nice judge they wont ask for proof but if you get a vicious judge they can ask you to come back with proof i.e. plane tickets or doctors letter.

i really didnt want to do it so i said i had a new job starting on the following monday and that if i didnt turn up on the first day i wouldnt get the job and i was dismissed. i took the week off work anyway becuase work didnt know if i was in a trial or not so it was a weeks extra holidays. i didnt want to chance any longer than a week though. i would have been pushing my luck a bit.

From my observation in court, it seems to be pretty easy to avoid jury duty. For a start you may be rejected by the defence and then people offer some very weak excuses. I've attended the empanelling at a few trials in the CCC and I've never heard any judge question any potential juror about the reason the have offered to be excused.

Many people say that they suffer a particular medical condition but they don't seem to be asked for evidence such as a doctor's certificate. A 'weak bladder/bowels' seem to be a dead cert as well as the usual "I have a holiday booked next week". I've also heard "The oul back does be at me judge".

Perhaps the court register requests the proof afterwards?

    Hi,

I've just been called for jury duty next month, but my sister is getting married on the Thursday of the week.

Is this a valid reason to get off the duty, and would it be for the week or only for Thursday (and Friday). Also, do I write a letter, or do I make it known at court? What type of prove would I require?

    Thanks

I'd turn up on the first day and explain.... shouldn't be a problem

If you have no excuse but still want to opt then try to make yourself obvious. Like show up in biker gear and a helmet under your arm. Or wear a 3 piece suit and have a briefcase and a newspaper.

Of course, depending on wha the legal teams want, you could be guranteed to get picked based on the stereotype you show ;)

another way to get out of it is to shave your head, tattoo a swaztica to your forehead, and tell them you have a serious dislike for anyone who isnt white aryan race.

    sieg heil mon fur

or just tell them you have a wedding that week and cant do it. that is a valid excuse. (and maybe still do the tattoo. it will look great in the wedding photos).
