Employers Notice period

    Hi guys,

    I am working with an employer now for over a year. Towards the end of last year I went back to college for one day a week. My employers (being a small company) were happy enough with this but revised my contract so i got paid for the hours i did in the office rather than a salary (plus commission).

    HOWEVER, on the terms of the contract, if i decided, while on this part time structure, that i wanted to leave. I would have to give 2 months notice.

    I started back full time sooner than later and in passing, we agreed that things would go back to normal, however, no new contracts were issued.

    NOW the situation arrises where I am not happy in my current role and have the opportunity to move, however, if i dont give a full 2 months notice what is stopping them digging up this contract? What can they do?
    How do i go to my employee and request a new contract? What if they say no and then when i do leave, they get legal about it???

    My head is going in circles over this!
