Claim with USPS

I purchased a new mobile phone from ebay on the 18th Jan (Valued and insured for $500). I was tracking the item online with the USPS site and with An Posts site.

I noticed the item had arrived in Portlaoise but didn't move from there for days. I rang An Post about it and they told me that all that remained was the packaging (i.e. Phone was stolen). They delivered the damaged packaging to me the next day.

I contacted the ebay seller so he could start the claim process. Since then I have had to present the damaged packaging at my local Post Office and fill out a claim form for An Post.

The seller has told me that the claim is being processed and that he will send a replacement when the claim is paid by USPS. The claim process started on the 31st Jan but nothing much has happened since then!

Does anyone know how long I could be waiting for my new phone? I have googled USPS claims and from what I've read it can take months to be sorted!
I am worried that the claim will take weeks and if USPS don't pay up then I'll be stuck as the time will have passed to file claims with Paypal!

What do you guys think I should do? Any advice would be greatly appreciated!

Start a claim in Paypal, otherwise it'll be very difficult for you to get your money back. The seller is insured, so he'll also get his money (eventually) but if you let more than 30 (or 45 , not sure) days pass since you paid for the phone, then you won't be able to start a claim and the seller will be under no real push to refund you, and he could simply decide not to.

I know of one or two people who've been caught out this way, wait too long thinking the seller is honest, then he either can't be bothered or is dishonest.

Thanks for the reply "jor el", you just confirmed what I was thinking myself...

I have contacted the seller requesting a refund (he has always replied within a few hours) and if he doesn't refund me then I will put in my claim with paypal.

Is the claim process with paypal complicated? It seems a simple process from what I've read on their website, but they're obviously going to say that aren't they! :D .

It's a simple process. Some find it frustrating though as there can be times when it simply doesn't work. You can but try.
