So what shop will replace a Wii if it fails within 48 hours of buying?

The thread about the Dead Wii prompted me to ask who would be the best shop to buy A Wii off? On that thread it was pointed out that Game would more then likely replace the unit on the spot if they had it in stock. So does that make Game the better company to buy a Wii off of i.e. if you buy a Wii or DS tomorrow and something fails within 24-48 hours out of Gamestop, Smyths, Argos, Virgin, HMW Xtravision & Game, who would replace the console on the spot rather then giving you the old "We have to send it back to Nintendo for repair" story? I think if it goes faulty within 48 hours they should replace it on the spot. I ask this as I will be buying a Wii in the next couple of weeks, but I'm paranoid of getting a dud so any personal experience of dealing with these shops would be great!

I've worked for both Game and GameStop and they'll both replace it on the spot. Not sure about the policy for other stores.

AFAIK, it is your statutory right to demand a replacement, or a full refund, if the good breaks down within 30days.

    More here

Oh, and Wiis don't break down that often *cough*Xbox360*cough*...

I was wondering that myself as I bought a Classic Ipod in Argos and they woman on the till basically told me if it went wrong I'd have to contact Apple direct, even if it wouldn't even start when I took it out of the box, I suppose you have to fight for your rights, although I thought they can just offer to send it off for repair?

Whats Smyths or Xtravisons policy like on a console failing within a day or so of purchase?

aren't you entitled to a replacement for 2 weeks or so? Goods obviously aren't of merchantable quality if they break within 2 weeks!

Smyths replaced a Wii for me last weekend - Bought in October, opened at Christmas, disk read error last week. Brought it in with receipt, guy tested it and replaced it with a brand new one straight away. New receipt restarting the warranty too.

    That's not true.
The retailer has to replace or refund and in Argos's case, they will replace/refund within 14 days no quibble guarantee and then it's the sale and goods act.

There is virtually no law stating it must be replcaed immediately. The companies are entitled to try to repair then replace.

That said, vote with your money and dont bother with a place that doesnt give some kind of return policy.

    SDooM, you're wrong.

The Sale of Goods and Supply of Services Act states that a consumer is entitled to a replacement, full refund or a satisfactory repair in the event that the goods aren't of merchantable quality.

The key word is the one I've put in bold. Unless you're satisfied with a repair, you're under no obligation to accept one.

Hi Sleepy is that right, so if a shop says to you " tough luck we'll have to send it off to Nintendo Apple or Microsoft" and you say no I'm not happy with that please provide me with a replacement now or refund me the money, under the law they will have to comply?

    The small claims court maybe?

Start a thread over here - http://www.boards.ie/vbulletin/forumdisplay.php?f=580, I'm sure the posters over there'll know more about stuff like this.

Aaah.. that means the repair itself must be satisfactory i.e. the product must then be of merchantable quality. It doesn't mean the act of receiving a repair must be satisfactory.

As far as I know Xtra-Vision have a new policy with Nintendo consoles (i.e. Wii and DS),any faulty consoles will be replaced on the spot (if in stock, stock can't be ordered if not) within 2 years.

Don't bother asking staff about it,only managers would probably know about it. A woman came into our store the other day with a DS over a year old that was faulty and she was given a new one on the spot. Had to have the reciept of course.

Wow thats good to know, I had cracked hinge DS-Lite and when I bought it back to Smyths and asked for a new one they would only offer to send it off for me, which was a bit of a pain. Are all Xtravison managers obliged to follow this policy? i.e. if I bought a DS off local Xtravision and manager refuses to swap it out if it goes wrong can I push them on it?

All I know is our manager told me that this was a new policy and all managers in the district were told about it. I'd talk to the manager about the policy before buying the DS,just to be sure. But the same memo on returns was sent to all stores in the country and it says a replacement on the spot within 2 years for DS. I am pretty sure it is the same for the Wii but I am not 100% certain so I won't say it is definate.
