    surely as this salesperson has agreed to refund your deposit then he should do just that? write the letter and hand deliver it or send it by registered post and then give ten days for any reply before you can apply to the small claims court. good luck with this as this guys behaviour is scandalous!

    The important parts for you to note here are:

    If the supplier does not adhere to the terms of the contract (for example, delivery of a product takes significantly longer than stated) you may have a right to ask for your deposit to be returned.
    and
    If you pay a deposit to a supplier who, in return, holds an article for you and you change your mind about paying the balance the supplier may not in all these circumstances be obliged to return your deposit.

    How long did he originally say the repairs would take? If he said a day or two, and it actually took two weeks then you could count that as a significant delay. Conversely, since the repairs are now done, it could look like you've just changed your mind and may not be entitled to a refund.

    You should contact the Citizens Information people or the National Consumer Agency and see what they think.

    Thanks for the replies,
    We didn't agree a date for the car to be collect but we were called to the garage 3 times and told that it was ready.
    He would have let us drive the car away knowing the car had a hole in the rear lens which is a NCT fail. He did say he would cover NCT warranty but at our expense of time and money for a retest.
