My wife wants a new laptop and I'm recommending the dell XPS m1330. If she doesn't like it can she return it to dell even if theres no technical faults with the product?

If she doesn't like that laptop, she wont be happy with any, its a great machine. The only possible problem could be the screen size. There is also a 15" version of the XPS from Dell. Unless there is something faulty, you can't return the laptop as far as I know. All that info should be on the Dell website though

Under Consumer Law, no. There's a common misconception (an irritating one) that we can buy something and if we don't like it, send it back. However it is a very good lappy so she should like it very much.

Hmmmm. Isn't there something about distance selling that if you don't like something, you have seven days to return it, even if you don't like it?

Or is that in the UK?

    YES, she can return it.

Within 8 days from delivery afaik, but anyway, regardless of the exact no of days, it can be returned. Everyone who has said otherwise is incorrect unfortunately.

    EDIT -

So because it's considered 'distance selling' over the internet or by phone, the seller is obliged to accept a return and pay a refund even if it's not faulty? I presume this isn't the case if it's bought on the high st?

I heard of this 'cooling off period' before but thought it was at the discretion of the seller....you learn something new every day ;)
    Cooling-off period

Consumers are entitled to a cooling-off period of 7 days, which begins on the day that they receive the product. In the case of a service, the cooling-off period begins on the day the contract for distance selling was concluded or the day written confirmation of the contract was received. During the cooling-off period, the consumer can cancel distance contracts without giving a reason and without incurring charges or penalties other than possible charges incurred in returning the goods. If a supplier fails to provide written confirmation, the cooling off period is extended to three months from the date the goods were received or the contract for the provision of services was completed.

Upon cancellation, the distance seller is obliged to reimburse the consumer within 30 days. Once the contract is cancelled, any credit agreements entered into at the time of the contract will be cancelled as well.

Cancellation will not be accepted, however, in the following cases:

    * The provision of services have already begun with the consumer's agreement
    * The price of the goods or services is dependent upon financial market fluctuations that are beyond the supplier's control
    * The goods cannot be returned because they were made according to the consumer's specifications
    * The goods are audio/video tapes or computer software whose seals have been broken by the consumer
    * The goods are newspapers or magazines
    * The services are gaming and lottery services.

The goods cannot be returned because they were made according to the consumer's specifications

Would this be a problem with Dell?? Most Dell lappys are made according to the consumer's specs. I suppose bottom line is to call them up and make sure the cooling off period applies

Yes, if it is customised in any way, my understanding would be that the cooling off period does not apply.

you have 8 days to send it back for any reason what so ever. and you get your money back.
dell ask you to take a credit note and hassle you to hell, but your still entitled to a cash refund.

anything after 8 days, your not entitled to send it back in less there is a fault with it.
if there is, then dell will call to your house the next day or 2 days later and fix it.

the m1330 is amazing. got my dad one for xmas and its truly unreal. screen size isnt that bad either. its only 13" but hey its super fast and looks amazing.
