Flickr Spaceballs

    I noticed on a guys flickr page that when I went to save any of his photos I could only save the aul "spaceball" thing.

    I looked in my account for an option to turn the feature on but I couldn't see one.

    Is this exclusive to pro accounts or have I just missed an option?

    i think this relates to how the photos are protected.

    the flickr user can select who can download his photos and from memory the options are
    - self
    - friends
    - family
    - anyone

    so if he has selected just self for example then in you try to download the photo you get the spaceball and nothing shows as he doesnt want you to download the photo !

    someone will no doubt correct me if the above is wrong

    I thought it was on all of them if you have mozilla and select the image -drage the mouse across it will highlight the covering gif but the bottom edge of the real image pokes out so you can get it that way,
    I needed to get one of my own images off one day for a photography class and couldn't log into flickr on the college network.

    Firstly, you don't have the right to download anyone's photos without their permission. There's a little thing called COPYRIGHT. :eek:

    So, maybe you should contact the photographer, and if you like their photos, offer to buy them.

    What Paul said, tbh... At least ask to take their photos - You might even get a higher res image, so theirs dosn't show up pixelated.

    Ah, so it's in that setting. I had read "download" as view, but cool, must go try setting that up then.


    Well... it's a photo of me, do I not have some sort of right to my image? I didn't give him permission to take pictures at my concert etc etc etc.


    But that's not my point anyhows, I wasn't going to steal them for any use, just have them for my own record and I'd assume if he has them unprotected then it's ok, but they're not so I'm not going to.
    I was asking to find out how I could get the same protection on my photos, not in an attempt to circumvent his protection.

    No, even if it's a photo of you, you have no right at all to the photo nor to it's use. Copyright always remains with the photographer, unless there is a contract stating otherwise.

    No matter what you want the image for, taking a copy is illegal and in breach of copyright law. You should always contact the photographer and request a copy or offer to buy a copy of the image.

    Really? So then what's the deal with people signing releases etc?

    Surely by merely viewing it I'm downloading it though? It'd be in my temp folder I'd imagine.

    A model release is generally required for commercial uses of photos, and is actually a contract between photographer and subject. In most cases though, it's not needed.

    As for it being in your temp folder, that still does not give you the right to print/copy/display or use the image in any way. Copyright will always remain with the photographer, and you require their permission to use the image.

    Ah yes, looked it up and it seems you've no real right to your image unless you're in private/it effects your income. It didn't mention release forms so now I wonder what they're for.

    I don't have a problem with someone taking my photo at a gig, I've opened myself up to it by performing on a stage and I've taken loads of pictures of other performers in the past.

    Yeah,I understand copyright law to a certain extent, but my point (though how we got here from my original query I'll never know) is if I just download a photo, surely it's the same as viewing it on the internet. I never suggested I was going to use it for any purpose.

    No, you are making a copy of it.

    If you're into music, you should actually understand this concept. It's the same as illegally downloading a MP3 file of a piece of music.

    We got to this point because photographers are getting screwed over even more than musicians are in this respect, and you wanted to know how to get past the basic protection that some photographers have implemented to try and prevent their work being copied without their permission.

    Incidentally assuming I haven't misunderstood you, it's worth noting that there is nothing that you can do to YOUR account that will allow you to download a photograph from ANYONE ELSE's account if that person has decided that they will not allow it.

    Not entirely true... Copyright is a structure built around prohibitions, and not permissions. It lays out rules for things people cannot do with your work - it does not give you the right to demand permission before any use is made.

    Anyone is free to download and use a photograph taken by a photographer if it was to be used in anything that could be described as 'fair use', such as a work of parody or a public service editorial.

    Fair use is an American afaik?

    From what I gather, the nearest in Ireland is part of the Fair Dealing term, and the only section of which that dosn't require acknowledgement is private research or study*


    *I stand to be corrected, I'm not saying this is fact.
