    Is irish rail and cie in general subject to the provisions to the freedom of information act

    I don't know. Someone else might have some more info. Until then, al I could suggest is to send a letter to the Group Secretary at Irish Rail, the Department of Transport, and the FOI Central Policy Unit and see what comes back.

    Technically, CIE is private company owned by the State and given that it is in competition with private transport holdings to operate public transport services, it would be very awkward to apply same on it without either infringing on it's rights as a limited company or on it's competition, who would in theory be liable to be open to the same laws. Can one imagine Aircoach or Luas being made to comply with same? I'm not suggesting that it is right or wrong not to be applicable to FOI, just the logistics of same would be fun. As with any company, CIE are covered by the Data Protection Act of 1988, which relates to information held in electronic form.

    As an aside, some of CIE's information would be accessible under FOI from the Department of Transport and the Rail Procurement Agency, who are covered under same. Alternatively, you may access some CIE records via the Irish Railway Records Society; this body holds virtually all of Irish Rail's records, and much of the old railway companies of Ireland. Their website is www.irrs.ie
