Demolition of unauthorised dwelling

    happy new year and all

    Would anyone have any ideas about this???

    A farmer said to his son here's a field of mine go and apply for planning for a house. The son got the planning, the father still owns the field.

    The son put a mobile home onto the land and built some extra space onto the side of the caravan. He moved in with the wife and put off building until finances were available.

    They now have an enforcement notice ordering them to demolish the unauthorised dwelling.

    Question - 1

    Should the planners have addressed their concern about the illegal dwelling to the owner of the land, the dad, rather than the son?

    Question - 2

    What is the law around a "site office"?
    Surely it should be allowed to have light, heat and running water as well as a toilet?
    Are there any restrictions on the size of a site office?

    As for who it was address to, I don't suppose it matters. It would depend on how the letter was worded, either to the person who was living in an unauthorised dwelling, or the landowner informing him that there was a person/or people living on his land. I would imagine that a letter should go to both. To cover situations where they are not father and son.


    As for a site office, it would of course be allowed to have light, heat and drinking water. As well as electricity. As for size, what ever is required I would imagine. Its a temporary structure,

    BUT a caravan is not a site office, as it is not temporary. And even more importantly, you can't live in a site office.

    Q.1 Wont be answered here as it now pertains to ongoing litigation and that is out of our territory - see a solicitor. In fact Im going to snip it.

    Q2. You need permission for a site office and a mobile home and I see where you are trying to go with this by claiming that the mobile home and/or the piece added to it is a site office. Again you are into legalities here and are attempting to elicit information on how to flaunt the planning laws.

    In fact the more I think of it the more this shouldnt be discussed at all. Thread locked.
