    i sold an item on ebay and shipped it and the buyer had recieved it broken and they have filled a dispute,I had already transfered the funds to my account about 5 days ago and i presume they are now in my bank account.

    now my paypal balance is -260.my question is,if my paypal funds have already been transfered into my account can paypal charge my credit card the money to give back to the buyer or do they need the money to be in the paypal account to do so?

    PayPal only take the money from your PayPal balance... they won't take it from your credit card or direct debit.

    Any payments you receive will come off this negative balance..

    Just make sure the buyer returns the item to you, if it wasn't your fault then you can claim off the post office

    so can i just close my paypal account afterwards ,so i wont have to pay paypal?

    They won't take money from you, no... but if you have a negative balance in PayPal then you are going to owe that money to PayPal.

    That money is on hold until your dispute is resolved, if it goes in buyer favour they will be due a refund from you - you will remain negative/possibly restricted until you refund them. PayPal may refund the buyer some of the amount depending on the protection on the payment then you will just owe that amount to PayPal. And PayPal don't just forget about money owed to them :D

    Your best bet is to ask the guy to return it to you, give him his refund and then claim from An Post / whoever handled the item for damaged goods.
