Should I seek a fee?

    One of my photos has been used by the club I support to launch their onli9ne shop.

    I had provided it to them for use at their request in the website gallery.

    Now I find they have it at higher res on the splash page. http://www.stpatsfc.com/

    Question is should I seek my normal fee?

    A difficult one that. You should certainly contact them and say that the image was provided for their gallery only, and comment about it's use as their main splash image. They may pay you for it, but from the sound of things, they might just remove it and use a different image.

    Maybe a lesson for everyone there. When someone requires a low reg image don't supply a high res one as well/instead.

    Agreeing with Covey above.

    If you've just given them a photo, without specifying what you want it to do, it can go into a vague area in the law...

    If it was a club you're supporting etc etc etc... I'd probably go down the nicer road and leave it off, or ask for some credit. They're not selling the image itself, which would be a different story altogether!

    I wasn't vague when supplying the photo originally as it was clearly stated for non commercial use only on the website for the match report and for a low res version for use in the gallery.

    Could well have been an innocent mistake by some webbie not knowing the limitations with respect to the image.

    But worth a mention to them if only so as to flag your concerns. At least then they will think twice about abusing your good will.

    Maybe you could ask for a season ticket by way of compensation? But then how much would that be worth!! Only joking.

    Maybe you could contact the admin and ask "innocently" how long your pic is going to remain on the website because you only gave permission for low-res web use and hi-res magazine use.

    Or maybe you could make a "mistake" as well and send in an invoice?

    Seriously though, I don't know what you said to them when you gave it to them, but if you really don't want it up, let them know.

    If your a supporter and don't really mind, leave it be but tell them to put your name on it. That would be the very least I'd want.

    i'd approach them, let them know of the issue in a friendly manner, and see what they say. if they offer nothing, i'd let them know that you're not happy with the situation; they won't want to change the cover image, it'll be hassle for them. maybe ask for something from the shop?

    it'll keep you on friendly terms with them, and possibly get you an item you wouldn't have otherwise got for free.

    My opinion would be to at least convey your annoyance to them at a breach of your agreement. It seems to be the general attitude of clubs/officials here to see how much they can get away with like this.

    Charging a fee would be your own call but I think you would definitely be entitled to.

    Exactly, and the online shop is a commercial venture.

    On the other hand, if you request a fee they will likely take it down and stick up one they have for free. Imagine if it was a united fan, they'd be trilled to have it up,
    i'd be more than happy to have my pic chosen for my club. Ask for your name to go under it and wave the fee.
