Local Authority's Road Powers

    LA have many powers dealing with roads issues.

    Just wondering if they were to change the existing road use for example banning a right turn how would they do it.

    Is there any public input into this?

    For some thing that simple, I imagine the area engineer could authorise it himself. However the request is usually from somewhere else, they don't do things like that by themselves.

    For more complicated schemes, e.g. making a road into a QBC, it has to go to public consultation, etc.

    In between, I imagine it will be agreed between the area engineer and the area committe of the council

    Hmmm, speed limits are always set as bye-laws which require councillors to vote them into force. A right turn ban may have to go through the same procedure to be legally enforcable.

    With out giving too much away the situation is that the local engineer is banning a right turn due to "safety" reasons and it is gona upset a few people so I was wondering can the public via some professional can appeal this situation.

    I'm not sure about an appeal but you would need to prove that the junction as it exists is not unsafe. You would also need to examine the proposed alternative access point when the right turn movement is banned. The alternative access could become equally as unsafe as the original junction thereby creating the same problem in a different location.

    The sign could be altered to say

    No right turn between 0700 - 1000

    No right turn except access

    That really doesnt work as right turns would be done if it is physical possible. If you ban them over a certain time peroid people dont expect right turns to happen and ilegal right turns can cause safety problems. Dont thik this is an option.

    Best thing to do is:

    a) find out what the "safety" benefit is - ask the LA;
    b) if you're not happy then ask your local councillor to put a question or motion down at the next area committee;
    c) the LA needs to consult with the Gardai - so you may be able to discuss it with them...................................but don't hold your breath!!!

    We know what the safety issue is but safety is subjective so its difficult to argue.

    I dont think the councillors would help. Its complicated!

    THe LA can make the orders the Garada inforce them but can they reverse the orders?
